§ 2.61 CONFIDENTIAL INFORMATION.
   (A)   Information and data furnished to the City Manager with respect to the nature and frequency of discharge shall be available to the public or other governmental agencies without restriction. Wastewater constituents and characteristics will not be recognized as confidential information. When requested by a discharger furnishing a report, the portions of a report which may disclose trade secrets or secret processes shall not be made available for inspection by the public unless required by law, but shall be made available upon written request to governmental agencies for uses related to this chapter, the NPDES permit, and/or the pretreatment programs; provided, however, that such portions of a report shall be available for use by the state or any state agency in judicial review or enforcement proceedings involving the discharger furnishing the report.
   (B)   Where a discharger has mass based limits as allowed by federal categorical pretreatment standards on a production basis, the production data necessary to determine compliance shall be available to the public.
   (C)   Where application of the combined waste stream formula is necessary to apply federal categorical pretreatment standards to a discharger, the flow measurements and other data used in the calculation shall be available to the public.
