(A) Under current federal and state laws, rules and regulations, the city is held responsible for the discharge of wastewater into the POTW; therefore, the city has the right and obligation to inspect connections and discharges to its system in order to confirm compliance with state and federal laws and provisions of this chapter.
(B) The City Manager and other duly authorized employees of the city bearing proper credentials and identification shall be permitted to enter upon all properties at reasonable times for the purpose of inspection, observation, measurement, sampling and testing in accordance with the provisions of this chapter. Any person who uses, applies for use and/or is connected to the POTW under this chapter shall be deemed to have consented to inspections pursuant to this section, including entrance upon that person’s property at reasonable times to make inspections. In the event that a violation of this chapter is identified, the property owner shall be responsible for all costs of inspection and remediation if necessary.
