(A) All districts generally.
(1) Construction signs. Construction signs shall be allowed in all zoning districts for the purpose of denoting the construction of individual buildings or projects as follows:
(a) Construction signs shall not be erected any earlier than four months prior to the actual commencement of construction.
(b) All construction signs shall be confined to the construction site.
(c) All construction signs shall be removed within ten days after completion of construction and in all cases prior to occupancy.
(d) The content of construction signs shall be limited to the project name/logo; the architect; the engineer; the contractor; the builder or developer; the lending institution; the business of the establishment under construction; its opening date; the type of units being offered; information pertaining to the price of the units; the leasing agent and his or her telephone number; and financing and amenities.
(e) No more than one construction sign shall be allowed per street frontage per project. Separate construction signs may be allowed in planned developments in accordance with the type of buildings to be constructed in the planned development.
(f) The maximum size of any construction sign fronting on Routes 25, 72 or 68 shall be 100 square feet. The maximum size of any construction sign fronting on any other street shall not exceed 50 square feet.
(g) Construction signs shall not exceed nine feet in height.
(h) Construction signs shall be located with a minimum setback of 15 feet.
(i) Construction signs shall not be illuminated.
(2) Directional signs. Signs which provide only direction or information for vehicular movement to churches, public places, shopping centers and places of public accommodation shall be permitted as follows.
(a) Directional signs shall not exceed four square feet per sign.
(b) There shall be no maximum number of signs, but the number of signs and location of all directional signs shall be as determined by the Village Engineer as necessary for safety.
(c) Except within residential or agricultural districts, directional signals may be illuminated.
(3) Development identification signs. Free standing signs shall be permitted for the purpose of identifying planned developments, subdivisions or retail commercial development of three acres or more, subject to the following conditions:
(a) There shall be a maximum of one free standing signs for each planned development; provided, however, that additional signs may be granted by the Building Official where the planned development has multiple frontages along public street.
(b) The total size, including the base of a free standing sign shall not exceed nine feet in height, seven feet in width, nor 16 inches in thickness.
(c) The sign area shall not exceed 35 square feet per side, limited to two sides, or 70 square feet total. A retail commercial or multi-use planned development of three acres or more may be granted a sign area not to exceed 63 square feet per side, limited to two sides or 126 square feet total.
(d) The sign shall be located such that the nearest edge shall be set back a minimum of 15 feet from the frontage property line.
(e) The sign shall not impede normal pedestrian movement nor obstruct the driver line-of sight for motor vehicle traffic.
(f) Except within residential or agricultural, the sign may be illuminated.
(B) Residential or agricultural districts (E, R-1, R-2, R-3, R-4, R-5, AG-1).
(1) Real estate signs. Real estate signs shall be permitted as follows:
(a) There shall be a maximum of one real estate sign per zoning lot, except that on a corner lot having frontage on two streets, two signs shall be permitted.
(b) Real estate signs shall not exceed five feet in height.
(c) The maximum size of a real estate sign shall be four square feet per side.
(d) Real estate signs shall be located with a minimum setback of five feet.
(e) Real estate signs shall not be illuminated.
(2) Home occupation/nameplate signs. Home occupation/nameplate signs shall be permitted as follows.
(a) There shall be a maximum of one sign per zoning lot.
(b) Home occupation/nameplate signs shall contain only the name, address, telephone number and occupation of the occupant.
(c) The maximum size of any home occupation/nameplate sign shall be one square foot.
(d) Home occupation/nameplate signs shall be located on front of building, next to or over door.
(e) Home occupation/nameplate signs shall not be illuminated.
(3) Church bulletins. Church bulletins shall be permitted as follows.
(a) There shall be a maximum of one such sign per zoning lot; provided, however, that a maximum of two such signs shall be permitted when the church to which the sign refers is located on a corner lot.
(b) The maximum size of any church bulletin signs shall be 16 square feet.
(c) Church bulletin signs shall be located with a minimum setback of five feet.
(d) Church bulletin signs shall not exceed five feet in height.
(e) A church bulletin sign may be illuminated.
(4) Building identification signs. Identification signs shall be permitted only in conjunction with a multi-family building or structure, subject to the following conditions.
(a) There shall be a maximum of one such sign per multi-family zoning lot; provided, however, that a maximum of two such signs shall be permitted when the multi-family complex to which the sign refers is located on a corner lot.
(b) The maximum size of any building identification sign shall be four square feet.
(c) Building identification signs shall not exceed five feet in height.
(d) Building identification signs shall be located with a minimum setback of five feet.
(e) An identification sign may be illuminated.
(5) Garage/rummage sale signs. Garage and rummage sale signs shall be permitted as follows.
(a) Only one such sign shall be allowed on the premises where the sale is taking place unless the property has frontage on two public streets, in which case two signs are permitted, one at each frontage.
(b) Three additional locations (not to include the public right-of-way or any buildings or structures thereon) may be selected for placement of rummage sale or garage sale signs announcing the same sale. Any sign to be placed on property owned by others must have verifiable permission of that property owner.
(c) No rummage sale or garage sale sign shall exceed three square feet in surface area.
(d) No garage/rummage sale sign shall exceed five feet in height.
(e) No sign shall be placed or otherwise erected for more than three consecutive days at a location permitted under this chapter.
(f) No garage sale or rummage sale signs shall be posted or displayed on street light poles, utility poles, street signs, traffic sign poles or otherwise erected upon any public right-of-way. Nor shall they be displayed on or within vehicles or be placed in such a location to cause an obstruction to the clear view of traffic.
(g) No rummage sale or garage sale signs shall be erected before 6:00 a.m., nor remain after 7:00 p.m., on any day of the sale. No such signs shall be erected prior to the sale date and all signs must be removed by 7:00 p.m. the next day.
(h) All sale signs shall have the street address and the date(s) of the sale printed legibly and be dark printing on a light background.
(i) No sale items shall be located and no activities shall be conducted on a public sidewalk, parkway area or other public property. Further, no sale items shall be left out for display later than 7:00 p.m. on any day.
(j) No more than three rummage or garage sales shall be conducted on the same premises in any calendar year. One rummage or garage sale shall be limited to a period of not more than three consecutive days and shall be conducted only during the hours between 9:00 a.m. and 6:00 p.m. The sale shall be conducted without the use of outdoor speakers, other amplification equipment or illuminated advertising devices.
(C) Business districts (B-1, B-2, B-3, B-4).
(1) Wall signs. Business identification wall signs shall be permitted subject to the following conditions.
(a) There shall be a maximum of one such wall sign for each business establishment; provided, however, that a maximum of two signs shall be permitted when the business establishment to which the sign refers is located on a corner lot.
(b) The maximum size of any business identification wall sign shall not exceed 10% of the front building facade area to a maximum of 100 square feet.
(c) Business identification signs may be illuminated.
(2) Free standing signs.
(a) In addition to the signs otherwise permitted in business districts, one free standing sign may be permitted where it is determined signage would be inadequate in identifying the business use and that one of the following conditions is met.
1. The use is a restaurant or service station;
2. The business use is located on a parcel which, by virtue of topographic conditions, substantially restricts the visibility of the premises; (Required landscaping, mounding and required building setbacks shall not be deemed an obstruction to visibility.)
3. A business use which employs a free standing sign in lieu of a wall sign due to the unique requirements of the business; and/or
4. Businesses located in the downtown area, B-1, will not be allowed a free standing sign.
(b) The required conditions to erection, relocation and maintenance of free standing signs are as follows.
1. The total size, including the base of a free standing sign shall not exceed 15 feet in height, seven feet in width, nor 16 inches thickness.
2. The sign area shall not exceed 35 square feet per side, limited to two sides or 70 square feet total. A retail commercial or multi-use planned development of three acres or more may be granted a sign area not to exceed 50 square feet per side, limited to two sides or 100 square feet total.
3. The sign shall be located with a minimum setback of 15 feet.
4. The sign shall not impede normal pedestrian movement nor obstruct the driver line-of-sight for motor vehicle traffic.
5. The sign may be illuminated.
6. The sign may incorporate a reader board within the allowable area.
(3) Real estate signs. Real estate signs shall be permitted as follows.
(a) There shall be a maximum of one sign for each zoning lot.
(b) The maximum size of the signs shall be 16 square feet.
(c) The signs shall not exceed nine feet in height.
(d) The sign shall be located with a minimum setback of 15 feet.
(e) No real estate sign shall be illuminated.
(4) Temporary window signs. Each commercially-zoned establishment may have one or more temporary window signs, subject to the following provisions.
(a) The aggregate area of window signs shall not exceed 50% of the total display glass area.
(b) Temporary window signs shall be limited to those describing or advertising a retail sale promotion or special sale or event and shall not remain in the window area of the establishment for a period of more than 30 days.
(c) Temporary window signs shall not be included in the computation of total allowable sign surface area.
(5) Signs accessory to automobile service stations and automobile stations/mini-marts. The following signs are permitted as accessory only to automobile service stations subject to the conditions specified below.
(a) No outside storage or display racks shall be permitted.
(b) One double-faced sign presenting the pricing of gasoline products sold upon the premises shall be permitted as follows.
1. Each sign shall not exceed ten square feet per side.
2. No letter or numeral on any pricing sign shall exceed ten inches by 14 inches in size.
3. No pricing sign shall exceed a height of 15 feet.
4. All pricing signs shall be located with a minimum setback of 15 feet.
5. Pricing signs may be combined as part of the permitted free standing business identification sign. Total area of such combined signs shall not exceed 45 square feet per side. All other provisions hereof shall apply.
(c) Only one ice machine and one soft drink machine will be allowed on exterior of building.
(6) Banner signs and balloon signs. Banner signs shall be permitted as follows for individual businesses and for shopping centers.
(a) Banner signs are only allowed for grand openings for the first 30 days of operations, at that address.
(b) The maximum size of any banner sign shall not exceed 10% of the gross area of the front facade up to a maximum of 150 square feet.
(c) Balloon signs under continuos inflation shall be permitted for the first 30 days of grand opening only at that location.
(d) The maximum size of a balloon sign shall be 25 feet in height.
(e) Balloon signs must be secured to the ground with appropriate tie downs. Roof mounting is prohibited.
(f) A liability insurance policy in the amount of $1,000,000 must be provided for balloon signs naming the village as additional insured.
(g) All banner and balloon signs shall relater to the activity being conducted on the premises where they are placed.
(7) Awning or canopy signs. Letters may be painted or otherwise permanently affixed to any permissible awning or canopy subject to the following conditions.
(a) Lettering and/or symbols shall not project above, below or beyond the physical dimensions of the awning or canopy.
(b) Awning or canopy sign area shall count toward the total wall sign area permitted hereunder.
(8) Signs accessory to new car dealerships. The following signs are permitted in the B-4, automotive new car dealership only:
(a) Two double-faced free standing signs:
1. One not to exceed 75 square feet per side;
2. One not to exceed 50 square feet per side;
3. Both no taller than 30 linear feet from average grade; and
4. Minimum set back 20 feet from property line.
(b) One double faced ground sign:
1. Not to exceed 25 square feet per side;
2. Not to exceed five feet in height above average grade; and
3. Minimum set back 20 feet from property line.
(9) Projecting signs.
(a) In addition to permitted wall signs, any commercial or institutional activity in the B-1 district may display one projecting sign on the building in which that activity occurs per street frontage.
(b) Every projecting sign, including the frames, braces and supports thereof shall be securely built and designed and may require approval from a structural engineer or registered architect as requested by the Zoning Administrator.
(c) Projecting signs must clear sidewalks by at least ten feet and may project no more than three feet from the building or closer than two feet from the back of curb edge of the sidewalk, whichever is less.
(d) Projecting signs are not permitted at the intersection of streets, except at right angles to a building front.
(e) Projecting signs shall not extend above a point 15 feet above the ground.
(f) Projecting signs shall not exceed ten square feet with a maximum of two feet in width and five feet in height.
(g) Prior to granting a permit for the erection of a sign to be located anywhere within the Historic District of the village or to be attached to any building or premises of any building outside the Historic District, but within the corporate limits of the village and constructed prior to the year 1900, the owner must make application to the Historic District Commission (HDC) to review the application and submit recommendations, pursuant to the guidelines set forth herein.
(10) Temporary sign. A temporary sign permit shall only be issued for a maximum of 30 days for the following occasions:
(a) Special event involving six or more separate businesses in a coordinated fashion or a special event sponsored by public, charitable, educational or religious organization;
(b) Grand opening for an individual business when it is a new business, under new ownership, or reopened after being closed for one month or more;
(c) Daily temporary (permit not required). A sign that is placed in front of a business on a daily basis and taken in nightly. This sign may utilize the public sidewalk immediately in front of the business for display. This type of sign shall not exceed nine square feet in total display area of all visible sides, and should be in close proximity to the front door. Examples:
1. Sandwich board 18 x 36 inches with display copy on two sides.
2. Three-legged easel with a single side display area of 36 x 36 inches.
(D) Office districts (O-D).
(1) Site identification. All signs in the O-D district shall be limited to the following.
(a) There shall be one sign per lot.
(b) Signs are restricted to the front yard only.
(c) Signs are permitted for identification purposes only, no advertising.
(d) Signs shall not exceed four feet in height from the average grade in the 30-foot front yard landscape area.
(e) The maximum area of any sign shall be limited to 32 square feet in size.
(f) No edge of the sign shall be closer than 20 feet from the right-of-way of any public street.
(g) No sign shall be allowed on any wall or window of any building within the district. It is the intent of this provision that all forms of outside advertising shall be prohibited.
(h) Signs shall be limited in color to brown and white or black and white or a color which blends with or matches the color and texture of the building.
(i) Flashing and rotating lights on signs are prohibited. All mechanical devices on signs are prohibited. External lighting is allowed.
(2) Real estate signs. Real estate signs shall be permitted as follows.
(a) There shall be a maximum of one such sign for each zoning lot; provided, however, that a maximum of two such signs shall be permitted when the zoning lot on which they are located is a corner lot.
(b) The maximum size of any real estate sign shall be 16 square feet, per side.
(c) Real estate signs shall not exceed nine feet in height.
(d) Real estate signs shall be located with a minimum setback of 15 feet.
(e) Real estate signs shall not be illuminated.
(E) East Side Commercial Overlay District.
(1) District area. The area of the East Side Commercial Overlay District includes all lots zoned B-2, B-3, or B-4 with frontage on Highways 25 and/or 72 within the following boundaries:
(a) On the north, the south side of the Highway 68 right-of-way;
(b) On the south, the village corporate limits;
(c) On the east, the village corporate limits; and
(d) On the west, a north-south line crossing a point in the center of the Highway 72 right-of-way approximately 1,077.18 feet from of the center of the intersection of Highways 25 and 72 as measured down the centerline of Highway 72.
(2) Permitted freestanding signs. Freestanding signs shall be permitted in the East Side Commercial Overlay District subject to the following:
(a) One freestanding sign is permitted on each side of a lot with frontage on a public street provided that the width of the frontage is 100 feet or greater.
(b) In the event other provisions of this chapter permit other freestanding signs on a lot within the overlay district, each freestanding sign permitted by this subsection shall be in lieu of one other freestanding sign of the most similar size otherwise permitted on the lot.
(c) The total size of the freestanding sign, including all structural elements, shall not exceed 20 feet in height, 15 feet in width, nor 3 feet in thickness.
(d) The sign area shall not exceed the following:
1. For lots with a width of at least 100 feet but less than 250 feet, 125 square feet per side, limited to two sides or 250 square feet total.
2. For lots with a width of 250 feet and greater, 140 square feet per side, limited to two sides of 280 square feet total.
3. The freestanding sign shall have a minimum front setback of 15 feet and a maximum front setback of 30 feet.
4. The freestanding sign shall have a minimum setback of 100 feet from any lot located within a residential zoning district.
5. The freestanding sign shall not impede normal pedestrian movement nor obstruct the driver line-of-sight for the motor vehicle traffic.
(3) Electronic message display. For new car dealerships, gas stations, multi-tenant retail centers and amusement establishments only, the freestanding sign permitted in division (E)(2)(d)2., above, may contain a fully electronic message display consisting of words, symbols, figures or images that can be electronically or mechanically changed by remote or automatic means, including animated graphics and video, subject to the following:
(a) The area of the electronic message display shall not exceed 75% of the sign area.
(b) The intensity of illumination and the movement of any illumination or the flashing, scintillating or varying of light intensity shall not constitute a traffic hazard as described in § 156.03(E).
(4) Compliance with all other regulations. Except where expressly stated otherwise in this subsection, all freestanding signs permitted herein shall comply with all other applicable regulations contained in this chapter.
(F) Hilltop Commercial Overlay District.
(1) District area. The area of the Hilltop Overlay District includes all properties zoned B-2, B-3, or B-4 with frontage on Highway 72 within the following boundaries:
(a) On the west, a north-south line crossing a point in the center of the Highway 72 right-of-way approximately 1,077.18 feet from of the center of the intersection of Highways 25 and 72 as measured down the centerline of Highway 72; and
(b) On the east:
1. On the north side of Highways 72, the east right-of-way line of Highway 68; and
2. On the south side of Highway 72, a line parallel to and approximately 361.76 feet from the centerline of the Van Buren Street right-of-way a point in the center of the intersection of Highway 72 and Van Buren Street.
(2) Permitted freestanding signs. Freestanding signs shall be permitted in the Hilltop Commercial Overlay District subject to the following:
(a) One freestanding sign is permitted on each lot with a minimum of 100 feet of frontage on Highway 72.
(b) In the event other provisions of this chapter permit other freestanding signs on a lot within the overlay district, each freestanding sign permitted by this subsection shall be in lieu of one other freestanding sign of the most similar size otherwise permitted on the lot.
(c) The total size of the freestanding sign, including all structural elements, shall not exceed 15 feet in height, 10 feet in width, nor 3 feet in thickness.
(d) The sign area shall not exceed 50 square feet per side, limited to two sides or 100 square feet total.
(e) The freestanding sign shall have a minimum front setback of 15 feet and a maximum front setback of 30 feet.
(f) The freestanding sign shall have a minimum setback of 100 feet from any lot located within a residential zoning district.
(g) The freestanding sign shall not impede normal pedestrian movement nor obstruct the driver line-of-sight for the motor vehicle traffic.
(3) Electronic message display. For new car dealerships, multi-tenant retail centers and amusement establishments only, the freestanding sign may contain a static electronic message display capable of displaying words, symbols, figures or images that can be electronically or mechanically changed by remote or automatic means, subject to the following:
(a) The area of the electronic message display shall not exceed 75% of the sign area.
(b) The electronic display shall contain static messages only. Said messages shall change only through dissolve or fade transitions, or with the use of other subtle transitions and frame effects that do not have the appearance of moving text or images, but which may otherwise not have movement, or the appearance or optical illusion of movement, of any part of the sign structure, design or pictorial segment of the sign, including movement of any illumination or the flashing, scintillating or varying of light intensity.
(c) Each message on the sign shall be displayed for a minimum of ten seconds.
(d) The intensity of illumination shall not constitute a traffic hazard as described in §156.03(E).
(4) Compliance with all other regulations. Except where expressly stated otherwise in this subsection, all freestanding signs permitted herein shall comply with all other applicable regulations contained in this chapter.
(G) Manufacturing districts (M-1 and M-2).
(1) Wall signs. Business identification wall signs shall be permitted subject to the following conditions:
(a) There shall be a maximum of one such wall sign for each business establishment; provided, however, that a maximum of two signs shall be permitted when the business establishment to which the sign refers is located on a corner lot.
(b) The maximum size of any business identification wall sign shall not exceed 10% of the front building facade area to a maximum of 200 square feet.
(c) Business identification signs may be illuminated.
