§ 155.098 ASSURANCE FOR MAINTENANCE.
   (A)   The applicant shall be required to maintain all improvements and provide for snow removal on streets and sidewalks until acceptance of the improvements by the Village Board.
   (B)   Not less than 24 hours prior to any maintenance of any improvement by the subdivider during the period of the completion guarantee, the subdivider shall notify the Village Engineer and obtain his or her approval as to the nature and manner of the maintenance work to be done.
   (C)   (1)   At the time of the acceptance of the required improvements by the Village Board in accordance herewith, the subdivider shall file a maintenance guarantee with the Village Board in the amount of 15% of the estimated cost of the required improvements and in a form satisfactory to the Village Attorney. The guarantee may be held by the village for a period of 15 months after acceptance of the improvements for the purpose of:
         (a)   Guaranteeing and securing the correction of any defect in material or workmanship furnished for the surface improvements, latent in character and not discernable at the time of final inspection or acceptance by the village; and
         (b)   Guaranteeing against any damage to such improvements by reason of the settling of ground, base or foundation thereof.
      (2)   The maintenance guarantee shall also provide that, if the defects have so developed, then the guarantee may be applied by the village on matters to assure the correction of the defects.
