§ 155.003 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEY. Strip of land along the side of or in the rear of lots intended to provide secondary access to and from streets and lots and shall not be designated for general travel.
   BLOCK. A tract of land bounded by streets, or by a combination of streets and public parks, cemeteries, railroad right-of-way, shore lines of waterways or corporate boundary lines of the village.
   BOARD OF TRUSTEES. The President and Board of Trustees of the Village of East Dundee, Kane County, Illinois.
   BUILDING SETBACK LINE. A line, generally parallel with and measured from the lot line, establishing the required distance between the lot line and the permitted structure or building area.
   EASEMENT. A grant by a property owner for the use of a strip of land by the general public, a corporation or certain person or persons for a specific purpose or purposes.
   LOT. A portion or basic unit of a subdivision or other parcel of land fronting on a public street and intended to be the unit by which the land would be individually developed and transferred.
   OFFICIAL MAP. A map adopted by the Board of Trustees, as provided by law, showing the streets, highways, parks and drainage systems theretofore laid out, and any amendments and additions thereto resulting from annexation, approval and recording of new subdivision plats.
   OFFICIAL PLAN. The comprehensive plan adopted by the Board of Trustees, including all changes and amendments thereto duly adopted, as provided by law.
   OWNER. The individual, firm, association, syndicate, copartnership, corporation or trust or any other legal entity having sufficient proprietary interest in the land sought to be subdivided for purposes of commencing and maintaining proceedings to subdivide the land as provided by law.
   PATHWAY. A strip of land dedicated or reserved for the purpose of providing pedestrian and bicycle access to neighboring areas.
   PLAN, CONCEPT. A general map or drawing on which the subdivider’s schematic design for the subdivision of land is presented for discussion purposes prior to the expenditure of funds for preparing the preliminary plan.
   PLAT, FINAL. An accurate map, drawing or chart on which the subdivider’s plan for the subdivision of land is presented and which he or she submits for final approval and intends to record in final form.
   PLAT, PRELIMINARY. A detailed map, drawing or chart on which the subdivider’s design for the subdivision of land is presented and which he or she submits in form for review and approval, but not for recording.
   PROTECTIVE COVENANT. Recorded conditions entered into between public and/or private parties and constituting a restriction on the use of all or some private property within a subdivision or development for the mutual benefit of successor property owners and to provide protection against undesirable aspects of developments which would tend to impair the stability of values.
   ROADWAY or PAVEMENT. The paved area existing on the street right-of-way, exclusive of sidewalks, driveways or related uses and its width measured from back of curb to back of curb.
   STREET. The street right-of-way or easement, whether public or private, and shall not be considered as the area of the paving or other improvement on the street right-of-way unless the paving and improvement coincides with the boundaries of the right-of-way.
      (1)   STREET, PUBLIC. A street located within a dedicated right-of-way for the purpose of providing vehicular access.
      (2)   STREET, PRIVATE. A street located on private property for the purpose of providing vehicular access to that property.
      (3)   STREET TYPES.
         (a)   COLLECTOR OR SECONDARY STREET. A street which carries traffic from minor streets to the primary street system, including the principal entrance and circulation streets of residential areas and having direct access to abutting properties permitted (not permitted).
         (b)   CUL-DE-SAC. A street having one open end and being permanently terminated by a vehicle turn-around at the other end.
         (c)   MARGINAL ACCESS OR FRONTAGE STREET. A minor street which is parallel with and adjacent to primary streets and highways and which provides access to abutting properties and protection from fast, through-moving traffic on primary streets.
         (d)   MINOR OR LOCAL STREET. A street with limited continuity and used primarily as access to abutting properties.
         (e)   PRIMARY OR MAJOR STREET. A street of considerable continuity which serves or is intended to serve as a major traffic artery connecting large areas.
   STREET WIDTH. The shortest distance between the property lines abutting both sides of a street right-of-way.
   SUBDIVIDER. The owners or any other person, firm or corporation authorized by the owner, undertaking proceedings under the provisions of this chapter for the purpose of subdividing land. The terms APPLICANT, DEVELOPER and SUBDIVIDER are interchangeable.
   SUBDIVISION.
      (1)   The division of land into two or more parts or any division of land which involves new streets or easements of access. The term includes re-subdivision and, when appropriate, the context shall relate to the process of subdividing or to the land subdivided.
      (2)   Notwithstanding the foregoing, any division of land into no more than two parts meeting the following criteria shall not be considered a subdivision for purposes of this chapter:
         (a)   The division is immediately followed by the sale or exchange of part of the parcel so divided to an owner of adjoining and contiguous land; and
         (b)   The parcel so conveyed shall not exceed, in area, the lesser of 20% of the original area of the parcel before any division or one acre.
   VILLAGE. The Village of East Dundee, Illinois.
   VILLAGE ATTORNEY. The person or firm charged with the responsibility of providing legal counsel regarding municipal matters.
   VILLAGE ENGINEER. The person or firm charged with the responsibility of municipal engineering matters.
   VILLAGE PLANNER. The person or firm charged with the responsibility of municipal planning matters.
