§ 151.008 ADDITIONS, INSERTIONS, DELETIONS, AND CHANGES TO THE INTERNATIONAL BUILDING CODE—2006.
   “Chapter 1   ADMINISTRATION
   Section 101: General.
   101.1   Title. These regulations shall be known as the “Building Code of the Village of East Dundee” (hereinafter referred to as “this Code”).
   105.51   Expiration. Every permit issued by the village shall expire by limitation under the provisions of this chapter after 360 days and at that time all work must cease. Any permittee holding an unexpired permit may apply in writing to the Building Official for an extension for an additional 180 days at a cost of one-half (1/2) the original permit fee before the work may recommence.
   109.3.1   Spot Survey. After the foundation has been completed, prior to the beginning of construction on the structure, a spot survey prepared, signed, and sealed by a licensed Illinois surveyor or engineer shall be submitted to the village. The spot survey shall show the distance from the lot lines, height of the top of the foundation, established grades, and the proposed finished grades.
   110.1.1   Filing Certificates of Occupancy with Assessor. Subsequent to the issuance of a Certificate of Occupancy pursuant to the ordinances of the village, the Building Official shall file an executed Certificate of Occupancy with the Dundee Township Assessor.
   113.4   Violation Penalties. Any person who violates a provision of this Code or fails to comply with any of the requirements thereof or who erects, constructs, alters, or repairs a building or structure in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code shall be subject to a fine as prescribed by Section 151.999 of the village Code of Ordinances. Each day that a violation continues after due notice has been served shall be deemed a separate offense and shall be subject to additional fines.
   114.2   Issuance. The Stop Work Order shall be in writing and shall be posted in a conspicuous place visible from the street. Upon issuance of a Stop Work Order, all work shall immediately cease. The Stop Work Order shall state the reason for the order and the conditions under which the cited work will be permitted to resume.
   114.3   Unlawful Continuance. Any person who shall continue any work after a Stop Work Order has been posted, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine as prescribed in § 151.999 of the village Code of Ordinances.
   Chapter 3.   USE OR OCCUPANCY.
   Section 311: Storage Group S.
   311.2   Moderate Hazard Storage, Group S-1. Buildings occupied for storage uses including buildings classified as Group S-2, which include but are not limited to storage of the following:
Aerosols, Level 2 and Level 3
Aircraft hangers
Asbestos
Bags, cloth, burlap, and paper
Bamboos & rattan
Baskets
Beer or wine up to 12 percent alcohol in metal, glass, or ceramic containers

   Chapter 4.   SPECIAL USE & OCCUPATION REQUIREMENTS.
   Section 406: Motor Vehicle Related Occupancies.
   Section 406.2: Parking Garages:
   406.2.10   Sprinkler System. All public parking garages shall be equipped with automatic sprinkler systems and stand pipes as required by Section 903.2.10 (as amended) of this Code.
   Chapter 9.   FIRE PROTECTIVE SYSTEMS.
   Section 903: Automatic Sprinkler Systems:
   903.2   Where Required. Approved automatic sprinkler systems shall be provided in all new buildings and structures exceeding 7,500 square feet or four or more stories in height.
         Exception: Automatic sprinkler shall not be required in R-3 occupancies.
   903.2.12.1   Stories and Basements Without Openings. An automatic sprinkler system shall be installed throughout every story or basement of all buildings where there is not provided at least one of the following types of exterior wall openings:
         1.   Openings below grade that lead directly to ground level by an exterior stairway complying with Section 1002.2.2. or an outside ramp complying with 1003.3.4. Openings shall be located in each 50 linear feet (15,240 mm) or fraction thereof of exterior wall in the story on at least one side.
         2.   Openings entirely above the adjoining ground level totaling at least 20 square feet (1.86 m2) in each linear feet (15,240 mm) or fraction thereof of exterior wall in the story on at least one side.
   Chapter 10.   MEANS OF EGRESS.
   Section 1003: General Means of Egress.
   1003.3.3.3.1   Dimensional Uniformity. Stair treads and risers shall be uniform in size and shape. There shall not be a variation exceeding 3/16 inch (5mm) in the depth of adjacent treads or in the height of adjacent risers. The tolerance between the largest and smallest riser or between the largest and smallest tread shall not exceed 3/8 inch (9.5 mm) in any flight of stairs.
   Section 1009: Emergency Escape and Rescue.
   1009.1   General. In addition to the means of egress required by this chapter, provisions shall be made for emergency escape and rescue in Group R as application in Section 101.2 and Group I-1 occupancies. Basements and sleeping rooms below the fourth story shall have at least one exterior emergency escape and rescue opening in accordance with this section. Such openings shall open directly into a public alley, yard, or court. An escape and rescue window shall be required in the common area in every basement as well as each individual sleeping room within the basement.
         Exceptions:    4.   Basements with a ceiling height of less than 60 inches (2032 mm) shall not be required to have emergency and rescue windows.
   Chapter 11.   ACCESSIBILITY.
   1101.2   Design. Buildings and facilities shall be designed and constructed to be accessible in accordance with the Illinois Accessibility Code.
   Sections 1102 through and including 1109 are hereby deleted in their entirety.
   Chapter 18.   FOUNDATION SYSTEMS & RETAINING WALLS.
   1804.5   Timber Footings. This section is hereby deleted in its entirety.
   1805.6   Wood Foundations. This section is hereby deleted in its entirety.
   Chapter 31.   SPECIAL CONSTRUCTION.
   Section 3109: Swimming Pool Enclosures.
   3109.3   Public Swimming Pools. Public swimming pools shall be completely enclosed by a fence at least 5 feet (1613 mm) in height or a screen enclosure. Openings in the fence shall not permit the passage of a 4-inch (102 mm) diameter sphere. The fence or screen enclosure shall be equipped with self-enclosing and self-latching gates.
   3109.4   Residential Swimming Pools. Residential swimming pools shall comply with Sections 3409.4.1 through 3409.4.3.
         Exception: A spa with a safety cover complying with ASTM F 1346.
   3109.4.1   Barrier Height and Clearances. The top of the barrier shall be at least 60 inches (1613 mm) above grade measured on the side of the barrier which faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches (51 mm) measured on the side which faces away from the swimming pool. Where the top of the pool structure is above grade, the barrier is authorized to be at ground level or mounted on top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches (102 mm).
   Chapter 34.   COMPLIANCE ALTERNATIVES.
   3409.2   Applicability. Structures existing prior to December 15, 1954, in which there is work involving additions, alterations, or changes of occupancy shall be made to conform to the requirements of this section or the provisions of Sections 3402 through 3406.
   3409.2.3   Additions. Additions to existing buildings shall comply with the requirements of this Code for new construction. The combined height and area of the existing building and the new addition shall not exceed the height and area allowed by Chapter 5. If the structure is increased in floor area or number of stories, the entire structure shall be made to conform with the requirements of this Code for means of egress, fire protection, light, and ventilation.”
