ORDINANCE NUMBER 04-41
   AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE EAST DUNDEE CODE OF ORDINANCES
   WHEREAS, the Village of East Dundee is a home rule unit of local government under and pursuant to Section 6 of Article VII of the Constitution of the State of Illinois, has the authority to exercise any power and perform any function pertaining to its government and affairs, including but not limited to the power to regulate for the protection of the public health, safety, morals, and welfare; and
   WHEREAS, American Publishing Corporation of Cincinnati, Ohio, has completed the 2004 Supplement to the Code of Ordinances fo the Village of East Dundee (herein the "Village"), which supplement contains all ordinances of a general and permanent nature enacted since the prior supplement to the Code of Ordinances of the Village; and
   WHEREAS, American Legal Publishing Corporation has recommended the revision or addition of certain sections of the Code of Ordinances which are based on or make reference to sections of the Illinois statutes; and
   WHEREAS, it is the intent of the Village to accept these updated sections in accordance with the changes of law of the State of Illinois; and
   WHEREAS, it is necessary to provide for the usual daily operation of the Village and for the immediate preservation of the public peace, health, safety, and general welfare of the Village that this ordinance take effect at an early date.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF EAST DUNDEE, COOK AND KANE COUNTIES, ILLINOIS, AS FOLLOWS:
   Section One. That the 2004 Supplement to the Code of Ordinances of the Village as submitted by American Legal Publishing Corporation of Cincinnati, Ohio, and as attached hereto be and the same is hereby adopted by reference as if set out in its entirety.
   Section Two. Such Supplement shall be deemed published as of the day of its adoption and approval by the Village and the Clerk is hereby authorized and ordered to insert such supplement into the copy of the Code of Ordinances kept on file in the Office of the Clerk.
   Section Three. This ordinance is declared to be an emergency measure necessary for the immediate preservation of the peace, health, safety, and general welfare of the people of this Village and shall take effect at the earliest date provided by law.
   Section Four. Severability. If any section, paragraph or provision of this ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this ordinance.
   Section Five.  Repeal. All ordinances, resolutions, motions or parts thereof in conflict herewith shall be and the same are hereby repealed.
   Section Six. Publication. This ordinance shall be in full force and effect forthwith upon its adoption, approval and publication in pamphlet form as provided by law.
