§ 151.010 ADDITIONS, INSERTIONS, DELETIONS, AND CHANGES TO THE INTERNATIONAL MECHANICAL CODE—2006.
   “Chapter 1.   ADMINISTRATION AND ENFORCEMENT:
   Section 101: General.
   101.1   Title. These regulations shall be known as the “Mechanical Code of the Village of East Dundee” (hereinafter referred to as “this Code”).
   R-106.4.3.1   Expiration. Every permit issued by the village shall expire by limitation under the provisions of this chapter after 360 days and at that time all work must cease. Any permittee holding an unexpired permit may apply in writing to the Building Official for an extension for an additional 180 days at a cost of one-half (1/2) the original permit fee before the work may recommence.
   R-106.5.2   Fee Schedule. The fees for mechanical work shall be as indicated in Chapter 151 of the village Code of Ordinances.
   R-106.5.3   Fee Refunds. The Building Official shall authorize the refunding of fees as follows:
         1.   The full amount of any fee paid hereunder which was erroneously paid or collected.
         2.   Not more than 75 percent, excluding any and all costs incurred by the village of the permit fee paid when no work has been done under a permit issued in accordance with this Code.
         3.   Not more than 75 percent of the plan review fee paid when an application for a permit for which a plan review fee has been paid is withdrawn or cancelled before any plan review effort has been expended.
         4.   No fee shall be refunded where the permit has lapsed as specified elsewhere in the Code.
         The Code official shall not authorize the refunding of any fee paid, except upon written application filed by the original permittee not later than 180 days after the date of the fee payment.
   Section 108: Violations.
   108.4   Violation Penalties. Any person who violates a provision of this Code or fails to comply with any of the requirements thereof or who erects, constructs, alters, or repairs mechanical work in violation of the approved construction documents or directive of the Code Official, or of a permit or certificate issued under the provisions of this Code shall be subject to a fine as prescribed by § 151.999 of the village Code of Ordinances. Each day that a violation continues after due notice has been served shall be deemed a separate offense and shall be subject to additional fines.
   108.5   Stop Work Orders. Upon notice of the Code Official that mechanical work is being done contrary to the provisions of this Code or in a dangerous or unsafe manner, such work shall immediately cease. The Stop Work Order shall be in writing and shall be posted in a conspicuous place visible from the street. Where an emergency exists, the Code Official shall not be required to give a written notice prior to stopping the work. Any person who shall continue to work on the system after a Stop Work Order has been posted, except such work as that person is directed to perform to remove a violation or unsafe condition shall be liable for a fine of not less than $50 or more than $750.
   Chapter 3. GENERAL REGULATIONS.
   Section 304: Installation.
   304.3   Elevation of Ignition Source. Equipment and appliances having an ignition source and located in hazardous locations and public garages, repair garages, automotive service stations, and parking garages shall be elevated such that the source of ignition is not less than 8 feet (2438 mm) above the floor surface on which the equipment or appliance rests. Such equipment and appliances shall not be installed in Group H occupancies or control areas where open use, handling, or dispensing of combustible, flammable, or explosive materials occurs. For the purpose of this section, rooms or spaces that are not part of the living space of a dwelling unit and that communicate directly with a private garage through openings shall be considered to be part of the private garage.
   304.5   Private Garages. Appliances located in private garages and carports shall be installed with a minimum clearance of 6 feet (1829 mm) above the floor.
         Exception: The exception is hereby deleted in its entirety.”
