§ 51.37 RATES.
   (A)   There shall be and there is hereby established a monthly user charge/fee on a fiscal year basis, as established in the annual fee schedule, per 1,000 gallons to each user of the waterworks facility within the corporate limits.
   (B)   There shall be and there is hereby established a monthly fixed charge/fee on a fiscal year basis including debt service based on the size of the water meter as established in the annual fee schedule to each user of the waterworks facility.
   (C)   There shall be and there is hereby established a capital improvement charge (connection fee) as established in the annual fee schedule. When an existing service line is being upgraded, the difference between the existing service line and the upgraded service line size will be the fee charged. The water permit connection fee will have been paid at the time of the original installation and will not be considered in calculations for the connection fee when upgrading service lines.
   (D)   (1)   A minimum charge may be established in the annual fee schedule shall be applied to all users whose consumption does not exceed a set gallonage per billing period. This minimum charge shall be established in the annual fee schedule. Usage in excess of the set gallonage per billing period will be charged a fee, as established in the annual fee schedule, per 1,000 gallons.
      (2)   Where a connection services more than one dwelling unit on a property either within the corporate limits or outside of the corporate limits, the minimum charge shall be the number of dwelling units served by the service times the minimum bill or the actual number of gallons used, multiplied by the currently established water rate plus the other current charges, whichever is greater.
   (E)   The rates and service charges established for user charges shall be effective on bills to be rendered for the next succeeding billing period after approval and authorization of the Village Board. A copy of the water service charges shall be filed in the office of the Village Clerk and shall be deemed notice to all owners of real estate of their liability for service supplied to any user of the service of the water facilities of the village on their properties.
   (F)   The method for computation of rates and service charges established for user charges shall be made available to a user within 14 days of receipt of a written report for such. Any disagreement over the method used or in the computations thereof shall be remedied by the Director of Public Works within 14 days after notification of a formal written appeal outlining the discrepancies.
   (G)   All rates for service to properties outside the village corporate limits shall be 150% of the rates set forth in the annual fee schedule. Nothing in this chapter shall be construed to require or obligate the village to provide the service.
