§ 513.02 DISTRIBUTION OF MARIHUANA.

(b) Whoever violates this section is guilty of gifting in marihuana. Gifting in marihuana is a minor misdemeanor for the first offense. For any subsequent offense, or if the offense was committed in the vicinity of a school or the vicinity of a juvenile, gifting in marihuana is a misdemeanor of the first degree.
