Each employer, owner, operator or manager of a business shall, within 90 days of the adoption of this section (Ord. 112-93, passed 10-19-1993), adopt, implement and maintain a written smoking policy which shall, at a minimum, comply with the following.
(a) Any smoking employee may object, in writing, to his or her employer about smoke in the workplace.
(b) The employer shall, by use of walls, separation, partition or ventilating equipment, create a smoke-free area such as will protect any such nonsmoking employee who objects, in writing, and in the absence of such effective controls, the employer shall entirely prohibit smoking in the workplace.
