No person, with intent to defraud by sale thereof, shall place on any merchandise any label or tag which falsely describes the kind, number, quantity, weight, grade or quality of such merchandise. No person shall sell or offer for sale any merchandise upon which, to his or her knowledge, a label or tag has been placed, which labor or tag falsely describes the kind, number, quantity, weight, grade or quality of such merchandise.
