(B) Description of business categories. For the purpose of this section, the following descriptions shall apply.
APPAREL STORE. A retail establishment selling articles of dress, garment, or attire.
AUTO PARTS STORE. A retail establishment that sells new or restored mechanical components and provides other vehicle items.
BARBER SHOP. An establishment or person whose business is to cut hair and to shave or trim beards, and have received a state license of completion.
BEAUTY SHOP. An establishment or person whose business is to shampoo and condition hair, hair coloring, haircuts, apply relaxers and other treatments, and have received a state license of completion.
CIRCUS/CARNIVAL VENDOR. A public entertainment that features acts by acrobats, clowns, and trained animals. A traveling show featuring exhibits and rides.
FESTIVAL. An assembly of people gathered for an occasion of feasting or celebration for a specific recurring day or time engaged in a common activity.
FIREWORKS RETAILER. A person who purchases fireworks for resale to consumers. See the following version of this section in I.C. 22-11-14-5.5(b)(1); I.C. 22-11-14-4.5(b)(2)Cite; or I.C. 22-11-14-4.5(c)Cite; or from a tent under section I.C. 22-11-14-4.5(a)Cite. A RETAILER may sell consumer fireworks and items under the following conditions.
(a) The structure must be a Class 1 structure in which consumer fireworks are sold and stored.
(b) The sales site must comply with all applicable local zoning and land use rules.
(c) The weight of consumer fireworks in the structure may not exceed 3,000 gross pounds of consumer fireworks.
(d) The RETAILER holds a valid registration.
(e) A RETAILER that sold consumer fireworks and operated from a structure with a registration in 2005 may continue in operation in the structure in 2006 and the following years.
(f) Fire and building safety staff shall inspect tents and structures in which fireworks are sold.
(g) A retailer selling items referenced in this section at one or more temporary stands must obtain a fireworks stand retail sales permit.
FIREWORKS WHOLESALER. A person who purchases fireworks for resale to retailers. See the following version of this section in I.C. 22-11-14-5.5(b)(1); I.C. 22-11-14-4.5(b)(2)Cite; or I.C. 22-11-14-4.5(c)Cite; or from a tent under section I.C. 22-11-14-4.5(a)Cite.
FLORIST. A retail establishment or person whose business is selling flowers and ornamental plants.
GENERAL BUSINESS LICENSE. Any person or entity, who conducts, engages in, maintains, operates, carries on, or manages a business or occupation, thing, or device in exchange for monetary enumeration not otherwise defined or addressed by this section.
HARDWARE STORE. A retail establishment selling a large assortment of merchandise for home improvement repairs and general tools.
HAWKER. A person that goes from block to block or stationary and advertises merchandise with signage.
NAIL SHOP. An establishment or person whose business is to perform manicures, pedicures, and nail art and have received a state license of completion.
PROFESSIONAL SERVICES/FINANCIAL SERVICES. A business which primarily provides to the public the services of a professional licensee such as a CPA, realtor, physical therapist, massage therapist, veterinarian, insurance agent, optometrist, or other profession which is regulated or licensed by the state and/or federal government. The license shall be for the premises, and the fee shall be for inspection of the same to ensure compliance with the local and state building, fire, health, and zoning codes. Note that I.C. 36-8-2-10 provides that a unit of government may regulate the operation of businesses, crafts, professions, and occupations.
SOLICITOR/CANVASSER. A salesperson that travels throughout city boundaries or person to person, to solicit orders, subscriptions, or conduct a survey.
SPECIALTY STORE/SERVICE. An establishment that has a particular activity, occupation, or business in which one specializes.
THEATERS/ENTERTAINMENT. An establishment that offers live performances, motion pictures, or any live entertainment for entertainment purposes. A person or persons performing live for a venue (music DJ’s).
VARIETY STORE. A retail establishment selling a large assortment of merchandise excluding food.
VIDEO STORE. A retail establishment that sells or rents recordings of motion picture productions.
