§ 99.012 GAS LEAKS NEAR TREES.
   (A)   No person owning, maintaining, or operating any gas pipes or mains beneath the surface of any public way or public place in the city shall permit any leak to occur in the pipes or mains within a radius of 40 feet of any tree growing in any public way or public place in the city.
   (B)   In the event that a leak exists or occurs in any pipe or main, it shall be the duty of the person owning or using the defective pipe or main to repair the same immediately and to stop the leak in a manner so as to prevent a recurrence thereof, within five days after receiving notice, in writing, from the City Horticulturist, calling the attention of the person to the fact that the leak exists or has occurred. A separate offense shall be regarded as committed each day during which the person shall allow the violation to continue.
