§ 51.145 ENFORCEMENT ESCALATION.
   (A)   The District may escalate enforcement actions against IUs who are non-compliant with the District’s administrative orders specified in § 51.139, or the standards and limits contained in this chapter.
   (B)   The District shall impose progressively higher penalties or more stringent controls on an IU who:
      (1)   Displays repeated inability or unwillingness to meet a limitation or standard imposed by its discharge permit or this chapter;
      (2)   Fails to comply for less than good reason with consent orders to which it agreed; and/or
      (3)   Engages in misleading, obstructive, or affirmative misconduct in attempting to shield its activities in violation of this chapter or its discharge permit from detection, examination, or scrutiny by the District.
