§ 51.116 RIGHT OF ENTRY; INSPECTION AND MONITORING.
   (A)   The District shall have the right to enter the premises of any IU to determine whether the IU is complying with all requirements of this subchapter and any individual wastewater discharge permit or order issued hereunder. IUs shall allow the District ready access to all parts of the premises for the purposes of inspection, sampling, records examination and copying, and the performance of any additional duties.
   (B)   Where a IU has security measures in force which require proper identification and clearance before entry into its premises, the IU shall make necessary arrangements with its security guards so that, upon presentation of suitable identification, the District shall be permitted to enter without delay for the purposes of performing specific responsibilities.
   (C)   The District shall have the right to set up on the IU’s property, or require installation of, such devices as are necessary to conduct sampling and/or metering of the IU’s operations.
   (D)   The District may require the IU to install monitoring equipment, including meters and any other sampling equipment the District deems appropriate, as necessary. The facility’s sampling and monitoring equipment shall be maintained at all times in a safe and proper operating condition by the IU at its own expense.
   (E)   Any temporary or permanent obstruction to safe and easy access to the facility to be inspected and/or sampled shall be promptly removed by the user at the written or verbal request of the District and shall not be replaced. The costs of clearing such access shall be borne by the user.
   (F)   Unreasonable delays in allowing the District access to the user’s premises shall be a violation of this subchapter.
   (G)   (1)   Each IU shall provide and operate at their own expense, a monitoring facility to allow inspection, sampling, and flow measurement of each sewer discharge to the District. Each monitoring facility shall be situated on the IU’s premises, except where such a location would be impractical or cause undue hardship on the IU.
      (2)   The District may concur with the facility being constructed in the public street or sidewalk area providing that the facility is located so that it will not be obstructed by landscaping or parked vehicles. There shall be ample room in or near said sampling facility to allow accurate sampling, representative of the discharge, and preparation of samples for analysis.
      (3)   To ensure accurate flow measurement, the District reserves the right to require the discharger to install a flow measuring device of the District’s choosing. Said flow measuring device shall be property of the District. The facility, sampling, and measuring equipment shall be maintained at all times in a safe and proper operating condition at the expense of the IU. All monitoring facilities shall be constructed and maintained in accordance with all applicable local construction standards and specifications. Construction shall be completed within 120 days of receipt of the wastewater discharge permit by the IU.
      (4)   Calibration and maintenance must be performed on the approved flow measuring and recording equipment in accordance with the recommendation of the manufacturer, but no less frequently than one time per year. The permittee shall submit to the District, during the months of April and October, a report verifying calibration and maintenance of said measuring and recording equipment.
