§ 34.037 FIRE FORCE.
   (A)   Training. The members of the fire force shall attend school and be instructed in firefighting, first aid, and fire prevention for periods in each year which, in the judgment of the Chief, may be necessary for the proper training of the fire force.

   (B)   Residency requirements for members. Members of the fire force shall reside within the city, unless otherwise expressly permitted by law. If law permits a member of the fire force to reside outside the city, he or she shall hold no rank higher than that of a firefighter first class while he or she remains a nonresident.

   (C)   Outside interests.
      (1)   Every member of the fire force shall devote his or her entire time to the business of the fire force, and no regular, temporary, or special member of the fire force shall engage in or be engaged or interested in, directly or indirectly, any other business, enterprise, profession, or occupation.
      (2)   This provision, considered highly essential to the best public interest, shall be strictly complied with and shall be rigidly enforced. Any regular, temporary, or special member of the fire force who shall violate any provision of this section shall be liable to removal in the manner provided by law.

   (D)   Classifications of Service.
      (1)   The Council hereby reaffirms and restates that the City Fire Department shall consist of two classifications of service, as follows:
         (a)   Fire Suppression Service; and
         (b)   Fire Prevention Bureau (also known as Fire Inspection Bureau).
      (2)   Assignments to the administrative office of the Fire Department shall be deemed to be assignments within and among the Fire Suppression Service.
   (E)   Ranks.
      (1)   Ranks; fire suppression. The following ranks are hereby restated and reaffirmed, in descending order, for the Fire Suppression Service followed by the authorized maximum number of places or positions within each rank:

      (3)   Reduction in staff accomplished through attrition. While the total authorized Fire Prevention Personnel shall not exceed three, any necessary reduction in staffing levels which may exist as of the date this section is adopted shall be accomplished through attrition.
   (F)   Attainment of authorized staffing levels. Subject to the provisions of division (G) below, from and after the taking effect of this section, a firefighter who, at time of permanent separation from the Fire Department, holds a civil service rank in which the total number of occupants of that rank are in excess of the authorized number of positions for that rank as specified in division (E) above, shall not be replaced by the Board of Public Safety. Promotions of firefighters to a higher rank shall be made by the appointing power only if there are sufficient places available under such authorized number for that rank.
   (G)   Assignments to administrative positions. The Fire Chief shall make all assignments of Fire Suppression Service personnel, and shall, with the approval of the Mayor, assign Fire Department personnel to administrative duties. The Mayor shall assign a member of the Fire Department to serve as Director of the Department of Emergency Management and Communications.
