§ 38.056 NONREVERTING FIRE DEPARTMENT CAPITAL FUND.
   (A)   Established. There is hereby established a Nonreverting Fire Department Capital Fund for purchases of Fire Department equipment and other capital matters.

   (B)   Deposits.
      (1)   There is to be deposited into the Nonreverting Fire Department Capital Fund fees collected or grants received by the Department and any other lawful funds which may be used for similar purposes.
      (2)   Monies deposited in the Nonreverting Fire Department Capital Fund shall be used only for the purchase of Fire Department equipment and other capital projects.

   (C)   Designated uses. Monies from the Nonreverting Fire Department Capital Fund may be expended by appropriation of the Common Council and may be disbursed only on approved claims allowed by the Board of Public Works and Safety.

   (D)   Perpetual. The Nonreverting Fire Department Capital Fund shall be perpetual in nature; however, should the Fund terminate for any lawful reason, any balance in the Fund shall be transferred to the city’s General Fund.
