(A) (1) A variance from the terms and conditions of this chapter may be requested by the filing of a written petition with the Administrative Secretary of the Commission, setting forth the variance requested and any other information deemed necessary by the Commission.
(2) Upon receipt of this petition, the request for variance shall be included in the advertising and notice given for the public hearing regarding plat approval.
(B) Should the applicant request variance subsequent to the public hearing held on plat approval, another public hearing, advertised and held in conformance with the Commission’s requirements regarding public hearings, will be required.
