(A) Referral from school administration. The Superintendent of SCEC, or the Superintendent’s designee, or the Principal or Building Administrator of any public, private, or parochial school located within the territorial limits of the city, or the designee of the principal or Building Administrator of any public, private, charter, or parochial school located within the territorial limits of the city, may refer instances of observed or suspected parental educational neglect to the Director of the city’s truancy program:
(1) By providing the city’s law enforcement officer, school resource officer, or code enforcement officer with an affidavit setting forth the circumstances of the conduct alleged to constitute parental educational neglect; and
(2) Designating the city’s law enforcement officer, school resource officer, or code enforcement officer to serve personal notice on the minor’s parents.
(B) Referral from ECHA. The Executive Director of ECHA, or the Executive Director’s designee (including, but not limited to, an ECHA Property Manager or the Housing Choice Voucher Program Director), may refer instances of parental educational neglect to the Director of the city’s truancy program:
(1) By providing the city’s law enforcement officer, school resource officer, or code enforcement officer with an affidavit setting forth the circumstances of the conduct alleged to constitute parental educational neglect; and
(2) Designating the city’s law enforcement officer, school resource officer, or code enforcement officer to serve personal notice on the minor’s parents.
(C) Referral from North Township Trustee. The North Township Trustee, or his or her designee, may refer observed instances of parental educational neglect to the Director of the city’s truancy program:
(1) By providing the city’s law enforcement officer, school resource officer, or code enforcement officer with an affidavit setting forth the circumstances of the conduct alleged to constitute parental educational neglect; and
(2) Designating the city’s law enforcement officer, school resource officer, or code enforcement officer to serve personal notice on the minor’s parents.
(D) Referral from Law Enforcement Officer, School Resource Officer, or Code Enforcement Officer. The city’s law enforcement officer or school resource officer, upon observing a minor child not in school, in a public place, unaccompanied by an adult, and not appearing to be engaged in any activity constituting “good cause” for non-attendance at school, shall exercise the officer’s statutory authority per I.C. 20-33-2-23 to transport the minor to the school in which the minor is enrolled, and may further refer instances of parental educational neglect to the Director of the city’s truancy program:
(1) By providing an affidavit setting forth the circumstances of the conduct alleged to constitute parental educational neglect; and
(2) Designating a city law enforcement officer, school resource officer, or code enforcement officer to serve personal notice on the minor’s parents.
