§ 32.124 EMERGENCY MEDICAL SERVICE.
   (A)   Established. There is established, pursuant to I.C. 16-31-5, the City Emergency Medical Service.

   (B)   Health Department division. The City Emergency Medical Service shall be a division of the City Health Department.

   (C)   Fee schedule for ambulance service. The following schedule for ambulance user fees is hereby established.
      (1)   Fees.
         (a)   The fee for basic life support (BLS) ambulance service (BLS) shall be an amount as set by the city from time to time.
         (b)   The fee for advance life support (ALS) ambulance service shall be an amount as set by the city from time to time.
         (c)   A nonresident fee in an amount as set by the city from time to time shall be assessed when applicable.
         (d)   A nontransport fee shall be assessed in an amount as set by the city from time to time for all calls for ambulance service where:
            1.   The City Fire Department provides any type of medical treatment; and
            2.   The patient declines transportation thereafter.
         (e)   A mileage charge shall be assessed for all calls for ambulance service in an amount as set by the city from time to time per patient loaded mile and fraction over one-tenth thereof.
      (2)   Collection.
         (a)   The funds shall be collected at the direction of the Chief Fiscal Officer of the city.
         (b)   1.   The Law Department, or a full time employee of the Chief Fiscal Office, is authorized to initiate collections actions for the ambulance fees as well as well as medical bills and EMS bills for inmates/detainees in the custody of the city’s Police Department or in the city’s jail.
            2.   This includes, among other things, filing suit in City Court for the collection and for an arrangement for reasonable installment payments.
         (c)   That all inmates/detainees while in the custody of the City Police Department, or in the city’s jail, be individually responsible for their own medical bills for medical treatment, including EMS, while in the custody of the Police Department or in the city’s jail.
         (d)   That if there has been a payment to the city by either a private insurance company for the EMS run, or by a government program, the bill shall be considered paid and that no additional collection efforts will be made on the unpaid balance.
      (3)   Allocation. Money so collected shall be allocated to the city’s General Fund.
