§ 95.09 APPEAL PROCEDURE.
   (A)   Any applicant shall have the right to request reconsideration of a denial of a parade, event, block party, performance or filming permit to the Chief of Police. Within five days after the receipt of the denial, the denied applicant shall make the request by filing a written notice with the Chief of Police. The Chief of Police shall promptly act upon the request within five days following receipt of the notice of request.
   (B)   Any applicant shall have the right to appeal the denial of a parade, event, block party, performance or filming permit to the City Council. The denied applicant shall make the appeal within five days after receipt of the denial by filing a written notice with the City Clerk. The City Council shall promptly act upon the appeal at its next scheduled meeting following receipt of the notice of appeal.
   (C)   In the event that the City Council rejects an appeal, the applicant may file an immediate request for prompt judicial review with a court of competent jurisdiction. In the event of any such review, the city shall file its response to the complaint or appeal motion within ten days of service of same, and will join with the applicant in a application to the court for an expedited hearing and decision of the appeal at the next available term of court.
