§ 34.11 FIRE CHIEF; ASSISTANT FIRE CHIEF.
   (A)   The Offices of Fire Chief and Assistant Fire Chief are hereby established.
   (B)   The Fire Chief and the Assistant Fire Chief shall be appointed by the Mayor with the approval of the City Council pursuant to KRS 83A.080; and may be removed by the Mayor with the approval of the City Council.
   (C)   No person shall be appointed or act as the Fire Chief or the Assistant Fire Chief unless that person has taken the oath required by § 228 of the State Constitution and has provided a bond in the sum of $0, with corporate surety authorized to transact business in the state and conditioned upon the performance of the duties specified herein.
   (D)   Subject to the executive authority of the city and the rules and regulations promulgated by the volunteer firefighters and approved by the Mayor, the Fire Chief shall be responsible for the organization and operation of the Fire Department and shall supervise, direct, and control the equipment of the Fire Department and the volunteer firefighters in their response to fires and the extinguishment thereof and the plans, preparations, procedures, practice, and training in regard thereto, and may, as Fire Chief, perform or cause to be performed all other actions authorized by law, ordinance, or regulation.
   (E)   The compensation of the Fire Chief shall be in an amount to be established by City Council by ordinance, in accordance with § 31.02.
   (F)   The Fire Chief and Assistant Fire Chief shall reside in the city. An exception may be made only if it is determined by the Mayor, with the approval of the City Council, that a qualified person cannot be found that is a resident of the city.
