(A) There is excepted and excluded from the provisions of this chapter any mining activities which are presently in existence and producing minerals, including coal, on the effective date of this chapter.
(B) There is further excepted and excluded from the provisions of this chapter any planned mining activities for which an application for permit has been filed with the State Natural Resources and Environmental Protection Cabinet on the effective date of this chapter or any planned mining activities for which a permit has been issued by the State Natural Resources and Environmental Protection Cabinet on the effective date of this chapter.
