§ 90.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ABANDON.
      (1)   To forsake entirely, or to neglect or refuse to provide or perform the legal obligations for care and support of an animal by its owner, or his or her agent.
      (2)   The abandonment shall constitute the relinquishment of all rights and claims by the owner to the animal.

   AT LARGE. Off the premises of the owner, and not under the control of the owner or his or her agent either by leash, cord, chain, or otherwise.
   CAT (DOMESTICATED). Any member of the feline family, male or female.
   DOG (DOMESTICATED). Any member of the canine family, male or female.
   FOWL. Ducks, geese, and the like.
   KENNELS. Any licensed establishment that meets the guidelines of the Kentucky Revised Statutes and the guidelines set forth herein by the City Council.
   LIVESTOCK. Any animal other than domesticated species.
   OWNER. Every person having a right of property to an animal and every person who keeps or harbors an animal, has it in his or her care, or permits it to remain on or about the premises owned or occupied by him or her.
   PEN OR ENCLOSURE. An enclosure or pen used for the keeping of domesticated animals within the corporate limits of the city.
      (1)   All sides must be embedded into the ground a minimum of one foot or there must be a bottom panel attached to the sides.
      (2)   An ENCLOSURE must have a top panel that attaches to the sides.
      (3)   All ENCLOSURES must be not less than eight feet tall and not less than a minimum of 100 square feet per dog for large dogs; however, an ENCLOSURE for a small dog may be 50 square feet. A large dog shall be any dog 50 pounds or over. A small dog shall be any dog under 50 pounds.
      (4)   Regardless of dog size, all enclosures must be well ventilated and kept in a sanitary manner at all times.
   POULTRY. Chickens, turkeys, and the like.
