§ 51.03 RATES; PROCEEDS.
   (A)   Rates.
      (1)   In order to make the service proposed in this chapter revenue-producing and to defray the expenses of collection, removal, disposal, maintenance, cost of acquiring or construction of a garbage disposal system and necessary facilities, there shall be, and there hereby is established, a schedule of fees, rates, and charges for refuse collection, removal, and disposal, as follows:
         (a)   For periodic, routine, residential, and commercial collection services: $17 per month; and
         (b)   For commercial establishments whose refuse collection is sufficiently great as to require bi-weekly or more frequent collection: no less than $17 per month. An additional amount shall be charged for those customers with extra heavy amounts of refuse or for the customers that require special handling, and these charges shall be determined by the City Council or its designated employees.
         (c)   The solid waste collection fee per 96 gallon roll cart containers shall be $20.50 per container per month.
      (2)   The rates and charges set out herein shall apply against all residences, apartments, single-family units or single-person units and on separate residential units; and the rates shall apply as against the owners of the residences as well as the occupants or tenants thereof, and shall apply as to the persons in control of the residences; except that only one fee shall be collected for each separate unit as mentioned, but it may be collected from any of the persons mentioned herein, and all of the persons shall be jointly and severally liable for the rates charged.
      (3)   The rates charged for commercial customers apply to the owners or persons in control of the premises and to the tenants or person occupying same, in the same manner.
      (4)   All rates apply against those charged, and against the properties described, whether or not garbage or refuse is collected by the city from the properties described.
      (5)   In this chapter, the words COMMERCIAL CUSTOMERS, or COMMERCIAL COLLECTIONS, shall refer to garbage or refuse collection from any place other than that used exclusively as a home or residence.
   (B)   Use of proceeds.
      (1)   The proceeds of the collection shall be placed in a Garbage Collection Service Charge, Maintenance, and Operation Fund, to be used for the expenses of collection of garbage and refuse, including payment of salaries and wages to employees, truck operation and maintenance, repairs and replacement of equipment, expense on the city disposal grounds or landfill site as herein referred to and other matters relating to expended for garbage, trash, or refuse collection and disposal.
      (2)   Any surplus remaining in the fund quarterly shall be paid to the city for general municipal purposes, pursuant to the law provided for those cases.
