Sec. 6-129 Violations.
   (a)   An officer of the Town Metropolitan Police Department may take into custody any person violating the terms and provisions of Section 6-128(a) set forth hereinabove, as deemed appropriate by that officer. It shall be the duty of the police officer to contact a parent, guardian or other person having legal custody of the minor person in order to release the minor person to the custody of that person.
   (b)   In the event any parent, guardian or other person having legal custody of the minor person refuses to take custody of the minor child upon notification by the Town Police Officer, the following action may be taken by the Town Police Department: a local ordinance citation or uniform complaint and summons, in form prescribed for such purposes by the Department for such use, may be issued to that person.
