(a) Any alarm user who has false alarms in a calendar year shall be subject to payment of a fine or fines for such false alarms. The false alarm fine schedule shall be as follows:
(1) 1st false alarm: no charge;
(2) 2nd false alarm: no charge;
(3) 3rd false alarm: no charge;
(4) 4th false alarm: one hundred dollar ($100.00) fine;
(5) 5th false alarm: two hundred fifty dollar ($250.00) fine;
(6) Every false alarm thereafter will result in a five hundred dollar ($500.00) fine.
(b) False alarms which result from malfunction of the telephone system which connects the alarm to the central board shall not be charged as false alarm violations. The Chief of Police has the discretion to determine if other conditions were present which would justify he or she making a determination as to whether an alarm would be classified as a false alarm or not.
(c) All fines shall be payable to the Clerk-Treasurer of the Town and deposited to the General Fund.
