Sec. 5-30 Permit and Reservation Fees.
   (a)   All organized groups of at least ten (10) people and all non-profit and business organizations may occupy facilities as designed by the Park Board through permits.
   (b)   Permits issued are not valid for the entire park, but for only the area designated by the permit. The Park Board may consider applications for permits for events with attendance anticipated to exceed facility capacity on a case-by-case basis based upon the size of the area requested and the number of attendees.
   (c)   The following permit fees are established:

The following rental fees apply to the Town’s shelters (or pavilions):
Elmer Miller Park Shelter
   Friday-Sunday/Town Holiday:      Dyer Resident:      $110/hr, $60/hr for minimum 3-hour rental
                     Nonresident:          $300/hr, $160/hr for minimum 3-hour rental
   Monday-Thursday:            Dyer Resident:      $40/hr, $20/hr for minimum 3-hour rental

Northgate Park Shelter
   Friday-Sunday/Town Holiday:      Dyer Resident:      $160/hr, $80/hr for minimum 3-hour rental
                     Nonresident:          $400/hr, $210/hr for minimum 3-hour rental
   Monday-Thursday:            Dyer Resident:      $50/hr, $30/hr for minimum 3-hour rental

Central Park Shelter

Pheasant Hills Park North Shelter

   Monday-Thursday:            Dyer Resident:      $25/hr, $15/hr for minimum 3-hour rental
                     Nonresident:          $70/hr, $50/hr for minimum 3-hour rental
   * Indiana sales tax is collected on all above fees.
Athletic Field Rental Fees:
   In addition to paying the fees stated in this subsection, groups and organizations must provide a certificate of insurance naming the Town of Dyer as an additional insured, showing a minimum of one million dollars ($1,000,000.00) in liability coverage.
   Residents      $25 per hour
   Non-residents   $50 per hour
   Groups and organizations are considered residents if at least fifty-one percent (51%) of its members reside in the Town of Dyer. All groups must submit an up-to-date roster of all current members as part of its application if it is to receive the resident rate.
   All reservation fees are refundable to the applicant only at the discretion of the Parks Board.
Plum Creek Center Rental Fees:
The following rental fees apply to Plum Creek Center:
Friday through Sunday and Town Holidays
   For 4-hour rental:         Dyer Resident:   $350.00
                  Dyer Nonresident:   $450.00
   For 2-hour rental:         Dyer Resident:   $200.00
                  Dyer Nonresident:   $250.00
   For each additional hour:      Dyer Resident:   $90.00
                  Dyer Nonresident:   $115.00
Monday through Thursday
   Hourly (only option):         Dyer Resident:   $60.00
                  Dyer Nonresident:   $80.00
                  Dyer Nonprofit:   $50.00
All four-hour rentals include a free hour before for set up and a free hour after for clean-up added to their rental time. All two-hour rentals include a free half-hour before for set up and a free half-hour after for clean-up added to their rental time. Indiana sales tax is collected on all above fees.
   (d)   Vendor-Provided Program Fees. For programs provided by third-party vendors, the Parks Department may charge a fee to participants not to exceed 150% of the vendor’s charge to the Town for each participant. The fee percentage must be identical for all such programs.
   (e)   Security Deposit and Cleanup Charges.
The following security deposit is to be paid for rentals under this Section:
   Dyer resident:      $100.00
   Non-resident:      $300.00
The security deposit is refundable only if the permit holder leaves the rented facility in substantially the same condition as when its occupancy of the facility began. Any condition requiring cleanup by Dyer Park and Recreation personnel, or any damage to the park or equipment in the park by facility occupants requiring repair, are charged against the security deposit at the discretion of the Parks Board. Nothing in this provision limits the Town of Dyer from seeking all available remedies against the permit holder, including recovery of all attorney’s fees. If approved, the security deposit is returned by mail to the permit holder within sixty (60) days after the reservation date.
   (f)   Reduced Fees and Exemptions.
      (1)   The following permit holders receive fifty percent (50%) off the fees in this Section:
         a.   Schools located in Dyer;
         b.   Homeschooling associations located in Dyer;
         c.   Service clubs serving Dyer;
         d.   Veterans’ organizations;
         e.   Organizations of Dyer police officers;
         f.   Religious organizations located in Dyer; and
         g.   Full-time employees of Dyer.
      (2)   Town of Dyer departments, Parks Department programs, boards, commissions, and volunteer committees are exempt from fees.
      (3)   The provisions of this Subsection do not apply to rental fees for Plum Creek Center.
   (g)   Disposition of Revenue. The Clerk-Treasurer must deposit: (1) all shelter rental fees into the Parks and Recreation Fund; (2) all athletic field rental fees and Plum Creek Center rental fees into the Parks Activities Fund; and (3) all cleanup and damage deposits into the Parks Escrow Fund.
