Sec. 4-109 Revocation.
Any Certificate of Registration may be suspended or revoked by the Town Council for any of the following reasons:
   a.   Violation by the registrant of an ordinance of the Town of Dyer.
   b.   Violation by the registrant of any law, rule or regulation of the State of Indiana or of the United States of America, or any department or division of them.
   c.   Misrepresentation or falsification of statements in the application for a Certificate of Registration.
In the event the Town Council believes that the violation by the registrant can be cured or corrected, the Clerk-Treasurer must serve written notice upon the registrant setting forth the violations, and the registrant has between five (5) and thirty (30) days to cure and correct the violation and to submit evidence of the cure or correction to the Town Council. Before the suspension or revocation of any Certificate of Registration, the Town Council may give written notice to the registrant of the violation and set a date for hearing for the purpose of suspending or revoking the license or permits. Such a hearing must occur no less than ten (10) days after the personal service of the mailing of the written notice; however, in the event the Town Council believe that immediate and irreparable harm or damage to person or property may occur by reason of the violation, the hearing may be had after twenty-four (24) hours following the personal service of or the mailing of the written notice. The suspension or revocation is supplemental to any other proceedings provided by this Division and does not stay any other enforcement provisions under this Division.
Any registrant whose Certificate of Registration has been revoked may not reapply for a Certificate of Registration until the calendar year beginning after the year in which the Certificate of Registration has been revoked. The Town Council may deny a Certificate of Registration to any applicant who has had a revocation of a Certificate of Registration issued by the Town of Dyer. (Ord. No. 80-20, § 1, 4-8-80; Am. Ord.
