Sec. 4-145 Administrative Charges and Fees.
   (a)   Tax abatement administrative charges and fees are hereby established for the Town of Dyer, based on the type of tax abatement requested as set forth in the initial statement of benefits form filed by the applicant as follows, namely:
   REAL PROPERTY APPLICATION ONLY: (I.C. 6-1.1-12.1-3)
   Application Review Fee:   $250.00
   Clerk's Office Fee:      $250.00
   Annual Review Fee:      $150.00
   NEW EQUIPMENT APPLICATION ONLY: (I.C. 6-1.1-12.1-4.5)
   Application Review Fee:   $250.00
   Clerk's Office Fee:      $250.00
   Annual Review Fee:      $150.00
   MIXED REAL PROPERTY and NEW EQUIPMENT:
   Application Review Fee:   $350.00
   Clerk's Office Fee:      $250.00
   Annual Review Fee:      $250.00
   (b)   The designated application review fee and Clerk's Office fee in subsection (a) above must be submitted with the statement of benefits form at the time the same is filed. The Annual Review Fee must be paid to the Town each year with the submission of the Compliance with statement of benefits form.
   (c)   The Clerk's Office fee is nonrefundable if tax abatement is not granted or is withdrawn by an applicant before approval.
   (d)   An applicant who fails to file a timely, complete, and accurate annual tax abatement report must pay a noncompliance penalty not to exceed two thousand five hundred dollars ($2,500.00) as determined by the Town Council, and may be subject to termination of further tax abatement deductions.
   (e)   Any applicant who fails to achieve the estimates set forth in the tax abatement application, and related documentation, submitted and based upon which the Town granted the tax abatement, is subject to a noncompliance penalty of not less than five hundred dollars ($500.00) and not more than two thousand five hundred dollars ($2,500.00) for each year the applicant fails to perform or achieve the estimates set forth in its original application for tax abatement.
   (f)   The fees and charges contained in subsections (a), (b), and (c) above are collected by the Clerk-Treasurer’s Office, and inure to the Town’s General Fund.
