(A) No tattoo, body piercing, or body painting studio may be owned, operated by, or employ anyone who:
(1) Has been convicted of a felony offense involving sexual misconduct;
(2) Requires registration as a registered sex offender in the state;
(3) Has been convicted for felony possession, use, or intent to distribute a controlled substance; or
(4) Has been convicted for pandering, prostitution, soliciting for prostitution, lewd molestation, or sexual battery.
(B) Prior to the issuance of a permit for a tattoo, body piercing, and body painting studio, a criminal background check of the owner and operator shall be coordinated by the Police Department. A criminal background check on all employees shall be coordinated prior to the beginning of employment at a tattoo, body piercing, and body painting studio.
(C) The criminal background check fee shall be set by resolution of the City Council.
