§ 54.23 CRITERIA FOR SANITARY SEWER LINE EXTENSION CONNECTION EXEMPTIONS.
   (A)   The Board of Adjustment may grant an exemption for existing structures to connect to the extension of a sanitary sewer line if the following requirements are met:
      (1)   The existing private sanitary sewer system is determined to be in good working order;
      (2)   The existing private sanitary sewer system meets the minimum requirements of the Oklahoma Department of Environmental Quality; and
      (3)   Connection to the sanitary sewer line extension would be cost prohibitive.
   (B)   The city may negotiate an exemption for existing structures to connect to the sanitary sewer line extension in exchange for an easement or annexation into the city if:
      (1)   The existing private sanitary sewer system is in good working order; and
      (2)   The existing private sanitary sewer system meets the minimum requirements of the Oklahoma Department of Environmental Quality.
   (C)   Any existing structure granted an exemption shall be deemed a lawful nonconforming use as governed in the Zoning Code. Repairs and routine maintenance may by performed on the private sewer system as long as the following criteria is met:
      (1)   The cost of such repair or maintenance work does not exceed 50% of the replacement cost of such system or 50% of the estimated cost to connect to the public sanitary sewer line extension; and
      (2)   The existing private sanitary sewer system meets the current minimum requirements of the Oklahoma Department of Environmental Quality.
   (D)   The City Council may extend deadlines to connect to sanitary sewer system by motion or resolution.
   (E)   All other ordinances regulating nonconforming uses shall apply except when in conflict with this chapter.
