§ 51.41 REMOVAL OF CONSTRUCTION DEBRIS, BULKY WASTE, EXCESS REFUSE, AND EXCESS WASTE MATERIAL.
   (A)   Waste material and the debris from the construction, remodel, or repair of buildings, structures, or dwellings shall be removed by the owner, tenant, or contractor at his or her expense, and such waste material or debris shall not, without prior approval of the Superintendent, be stored in receptacles used for refuse collection by the Sanitation Department; provided, however, the city may dispose of such construction debris for an extra fee as established by a resolution of the City Council.
   (B)   The owner, tenant, or contractor creating, accumulating, or causing the creation or accumulation of excess refuse, excess waste material, or bulky waste shall request and have scheduled from the Sanitation Department the collection of such refuse and waste material.
   (C)   Persons desiring Sanitation Department collection of construction debris or large amounts of excess refine or other waste material shall request the temporary placement of one or more large capacity containers on the premises to be so served.
   (D)   Yard waste, except tree limbs and similar yard debris, shall be placed in bags not to exceed 35 gallons in volume or 50 pounds in weight when filled with the yard waste. All such yard waste shall be placed in secured bags or secured in separate piles. All tree limbs, brush, and similar yard debris shall be cut so as not to exceed four feet in length, two inches in diameter, and 25 pounds in weight. Tree limbs and brush may be collected by the city on a scheduled basis. The resident shall keep brush which is prepared for city pick-up in such a manner that it does not become a hazard or nuisance while awaiting collection.
   (E)   The city shall not collect limbs, logs, or brush cut by commercial tree trimmers or those persons who trim trees and brush for hire. The tree service or the owner or occupant of the premises shall have the responsibility of removing such brush and trimmings. Those holding a city license to trim trees shall by the holding of such license be understood to have the authority to haul the limbs, brush, logs, and other trimmings from the city.
   (F)   The owner, occupant, or contractor may contact the Sanitation Department to schedule a special collection. For all special collections, the owner, occupant, or contractor must contact the Sanitation Department at least three days in advance of the desired collection date. Special collection items may not be placed out for collection greater than 24 hours prior to the scheduled collection date. All special collections will be subject to rates established in accordance with § 51.45 of this subchapter.
