§ 157.29 POWERS AND DUTIES.

      (1)   Hear and decide appeals where it is alleged that there is error in any order, requirement, decision, or determination made by the Administrative Officer in the enforcement of these regulations;

      (3)   Authorize in specific cases a variance from the terms, standards, and criteria that pertain to an allowed use category within a zoning district as authorized by the Zoning Ordinance when such cases are shown not to be contrary to the public interest if, owing to special conditions, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship and so that the spirit of the ordinance shall be observed and substantial justice done; provided, however, the Board of Adjustment shall have no power to authorize variances as to use except as provided by city ordinance or state law; and
      (4)   Hear and decide special exceptions, other than uses permitted on review.
   (B)   Exceptions or variances may be allowed by the Board only after notice and hearing as provided by state law.
   (C)   In acting upon any appeal, such Board of Adjustment shall, in its consideration of and decision thereon, apply the principles, standards, and objectives set forth and contained in all applicable regulations, ordinances, and resolutions and the Comprehensive Plan.
