The Council may require either the applicant or the owner or user of the property on which the open pit or excavation are located, to post a bond, in a form and sum as the Council shall determine, with sufficient surety running to the City to pay any expense the City may incur by reason of doing anything required to be done by the City by reason of the failure to act, negligence or refusal to act or improper act by any applicant to whom a permit has been or will be issued.
