17-221: EXEMPTIONS:
   A.   Stage 2 And Stage 3 Exemptions: The following activities, users, or usages of water shall be exempt from the stage 2 and stage 3 water restrictions:
      1.   Watering upon the immediate premises of any commercial nursery raising plants, shrubs, or trees for sale;
      2.   Commercial car washes and service stations;
      3.   Washing of motor vehicles used in food transportation, food products, perishable goods or motor vehicles used for garbage collections;
      4.   Food producing crop for personal use or consumption only;
      5.   Lawns which have been treated by commercial nurseries, landscape gardeners, or similar type businesses, if:
         a.   The watering is completed within twenty four (24) hours from the treatment of the lawns; and
         b.   A sign is conspicuously posted on the premises stating the date and time of the lawn treatment; and
      6.   Newly planted lawns for a period of two (2) weeks with the posting of a sign which sets out the date of the start of such two (2) week period; and
      7.   Watering around the foundations of property structures by use of a hose.
   B.   Stage 4 Exemptions: The following activities, users, or usages of water shall be exempt from the stage 4 water restrictions:
      1.   Washing of motor vehicles used in food transportation, food products, perishable goods or motor vehicles used for garbage collections;
      2.   Watering around the foundations of property structures by use of a hose;
      3.   Watering upon the immediate premises of any commercial nursery raising plants, shrubs, or trees for sale;
      4.   Food producing crop for personal use or consumption only;
      5.   Commercial car washes and service stations;
      6.   Washing a vehicle at a car dealership or car rental establishment on the day the customer picks up the vehicle.
   C.   Stage 5 Exemptions: The following activities, users, or usages of water shall be exempt from the stage 5 water restrictions:
      1.   Washing of motor vehicles used in food transportation, food products, perishable goods or motor vehicles used for garbage collections;
      2.   Watering around the foundations of property structures by use of a hose;
      3.   Watering upon the immediate premises of any commercial nursery raising plants, shrubs, or trees for sale. (Ord. 1726, 9-9-2014)
      4.   Car wash use, as follows:
         a.   Definition: For purposes of this subsection C4, a "car wash" shall be defined as a place of business equipped for washing cars, trucks, motorbikes, boats, airplanes, or other motor vehicles and trailers.
         b.   Regulations And Restrictions:
            (1)   Unlawful To Wash Vehicle: It shall be unlawful for any person to wash a vehicle at any location other than a commercial car wash.
            (2)   Allowable Times For Washing Vehicles: Allowable times for washing vehicles are limited to reduce evaporation. It shall be unlawful for any person to use potable water (water provided by the city) to wash a vehicle:
               (A) At any time on Sunday or Monday; or
               (B) On any day, during the hours of seven o'clock (7:00) P.M. to seven o'clock (7:00) A.M.
               (C) The owner or operator of a self-serve or automatic car wash shall ensure that potable water (water provided by the city) cannot be used to wash a vehicle during the days and times proscribed.
            (3)   Nozzles: It shall be unlawful for any car wash to use a nozzle that discharges potable water more than three (3.0) gallons per minute.
            (4)   Car Wash Bays: It shall be unlawful for a car wash to wash any of its bays with potable water (water provided by the city), except on Fridays.
            (5)   Defense: It is an affirmative defense to prosecution that if a car dealer or car rental is preparing a car for pick up, it washed that vehicle (and only that vehicle) on the day of pick up by the customer.
      5.   Stage 5 exemptions, itemized in this subsection C, will automatically cease, without further action by the city council, in the event the municipal storage of water in Waurika Lake reaches a level of twenty five percent (25%) or less. (Ord. 1734, 1-27-2015)
   D.   Fire Hydrant Meters: The use of fire hydrant meters during stage 2, 3 or 4 is prohibited except for approved subdivision construction contracts and where building permits have been issued by the city. The use of fire hydrant meters during stage 5 is prohibited. (Ord. 1726, 9-9-2014)
