12-1108: MAINTENANCE OF LANDSCAPING:
   A.   It shall be the responsibility of the property owner to maintain in good condition all the improvements required by this chapter. Any required landscaping components shall be maintained and repaired if those components become damaged. Any vegetation that dies shall be replaced no later than the following planting season (spring or fall).
   B.   All development and property subject to the provisions of this chapter shall be maintained by regular weeding, irrigation, fertilizing, mowing, and pruning of plant materials in conformance with good horticultural practices.
   C.   All landscaping materials not properly maintained such that they become overgrown, exhibit evidence of weed and/or pest infestation, or fall into disrepair will be considered a public nuisance under the provisions of this Code and abated under the provisions therein.
   D.   All required plant materials which are removed or perish for any reason, must be replaced with similar materials of greater than or equal point value as the removed/perished materials as they were credited at the time of planting.
   E.   If Stage 3 water restrictions are invoked by the City of Duncan per section 17-220 of this Code, enforcement of the provisions of section 17-220 of this Code will be suspended during said restriction and for one hundred twenty (120) days thereafter.
   F.   When it is determined by the Community Development Director, or his/her designee, that improvements required by this chapter are not being maintained, it shall be his/her duty to give notice in writing to the property owner in accordance with section 12-1110 of this chapter.
