12-806: FREESTANDING MOBILE HOMES; LOCATION:
   A.   No freestanding mobile home or travel trailer shall be permitted in the city limits unless it is being offered for sale or parked for storage in accordance with the city's zoning regulations except as provided in this section.
   B.   The building official may issue permits for freestanding mobile homes on lots within the agricultural or residential zoning districts upon application by the owner of the lot, or the holder of a valid purchase contract, for the use and occupancy by the owner or members of his immediate family under the following conditions:
      1.   Applicant shall file an application for a permit on forms provided by the building official, providing a plot plan showing the locations of the proposed mobile home, lot dimensions, driveways and other existing or proposed improvements;
      2.   The application shall be accompanied by a list of all property owners within a three hundred foot (300') radius of any portion of the subject property certified by an abstracter;
      3.   The application shall be accompanied by a document showing consent to the mobile home application by all adjacent property owners and by eighty percent (80%) of the owners of all property within a three hundred foot (300') radius. Adjacent property includes all property bordering the property described in the application even though separated by a street, alley, easement, private road or other public way;
      4.   The building official shall mail notice of the application to all property owners identified in the list of property owners as certified by an abstracter and shall allow ten (10) days for response to the notice and be satisfied that the document of consent is adequate. The building official shall provide notice as herein required by first class mail, not more than three (3) working days after receipt of a complete application; and
      5.   Application for freestanding mobile homes shall be accompanied by a application fee in such sum as set by the council by motion or resolution.
   C.   Upon finding that the requirements of this chapter have been satisfied, the building official may issue a building permit in compliance with all codes, ordinances and rules of the city. In addition, the permit shall require the following:
      1.   The mobile home shall be placed upon and permanently anchored with cast in place concrete deadmen, screw augers, arrowhead anchors or other acceptable devices capable of sustaining four thousand eight hundred (4,800) pounds of tension without failure. Tie downs or anchors shall be located at each corner and approximately one-fourth (1/4) of the mobile homes length from each corner. Frame and over the top ties are required;
      2.   Mobile homes which are not set on permanent foundations shall be provided with skirting of the same or complementary materials as the exterior of the mobile home; and
      3.   All required improvements shall be installed within sixty (60) days of placement of the mobile home.
   D.   In instances where the building official is not authorized to issue a permit for a freestanding mobile home or travel trailer, or shall find deficiencies in an application and refuse a permit, the applicant may appeal to the board of adjustment of the city. Upon filing of an appeal, the building official shall transmit all application forms and attachments to the board with a statement as to the reason for his refusal to issue the permit. The board shall have the authority to direct the issuance of a permit in keeping with the spirit and intent of this chapter, following notice and hearing as required by the board for zoning ordinances.
