10-402: MARIJUANA PROHIBITED 1 :
   A.   It is unlawful for any person:
      1.   To appear or be upon or in any street, alley, place of business, or other public place while under the influence of marijuana;
      2.   To use, have, or possess marijuana, excluding medical marijuana, as provided for in Article VII of Chapter 8 of the Duncan Code of Ordinances, upon or in any street, alley, place of business, or other public place within the City;
      3.   To use marijuana in any place within the City except as legally prescribed by a physician licensed to practice in the State; or
      4.   To loiter about a place where marijuana is sold or furnished illegally.
   B.   For the purpose of this section, "marijuana" means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the derivative, mixture or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.
   C.   It is unlawful for a valid medical marijuana Patient License Holder:
      1.   To appear or be upon or in any street, alley, place of business, or other public place while under the influence of marijuana;
      2.   To use marijuana in or at any City owned property as defined in Section 8-601, et seq.(Prior Code ch. 14; amd. Ord. 1814, 10-27-2020)
