10-208: ILLEGAL ENTRANCE AND LOITERING:
   A.   It is illegal for any person to enter upon the property of another or into an area or structure on such property (whether such property, area or structure is public or private), when such entrance is plainly forbidden by signs or otherwise or when the property area or structure is enclosed, except when such entrance is in line of duty, or with the expressed, or tacit consent of the owner or person in charge, or otherwise by authority of law or ordinance.
   B.   It shall be unlawful for any person without lawful reason to trespass upon or loiter on or about the premises of any public or private school.
   C.   Loitering prohibited. No person shall loiter on private property that is customarily used by the public as an integral part of a commercial venture; nor is loitering allowed in the following instances:
      1.   In such a manner as to disturb the peace as defined by state law or ordinance; or
      2.   In obstructing the free passage of pedestrians or vehicles; or
      3.   Obstructing or interfering with any person lawfully seeking access or the use of the commercial venture conducted on the property or contiguous to said property.
      For purposes of this subsection, loitering is defined as remaining stationaty in one location, including walking around aimlessly, and sitting or standing in or out of a motor vehicle; to stand or wait around idly or without apparent purpose, or to linger or hang around in a public place or business where one has no particular or legal purpose.
      Notice. No person shall be guilty of a violation of this subsection unless the property owner or tenant has posted "NO LOITERING" signs or other notice oflikc meaning at the entrance or entrances to said property. (Prior code ch. 14; amd. Ord. 1315, 9-10-1991; Ord. 1847, 9-12-2023)
