8-723: LOCATIONS AND ZONING OF MEDICAL MARIJUANA BUSINESSES:
   A.   A fixed location is required for any and all medical marijuana businesses. Mobile medical marijuana sales of all types are prohibited within the City of Duncan; this includes, but is not limited to, trailers, recreational vehicles, and trucks.
   B.   With the exception of a commercial grower, it shall be unlawful to operate a medical marijuana business outside of an enclosed, fixed building. All City of Duncan medical marijuana business permits shall be issued only for a specific fixed location within an enclosed building.
   C.   Permitted use in zoning district: A City of Duncan medical marijuana business permit for a commercial medical marijuana business may be issued only in the following locations:
      1.   A medical marijuana dispensary shall only be located within one (1) of the following zoning classifications:
         a.   C-1 Neighborhood Shopping District;
         b.   C-2 Office Commercial District;
         c.   C-3 Planned Shopping Center District;
         d.   C-4 General Commercial District.
      2.   Commercial medical marijuana growing facilities shall only be located within one (1) of the following zoning classifications:
         a.   An organic greenhouse utilizing natural light, with no gases or chemicals, and single stack of plants:
            (1)   A-1 or A-2 Agricultural District;
            (2)   C-4 General Commercial District;
            (3)   I-1 Restricted Manufacturing and Warehousing District;
            (4)   I-2 Light Industrial District;
            (5)   1-3 General Industrial District.
         b.   A medical marijuana growing facility utilizing artificial light, fertilizer and pesticides not exceeding maximum allowable quantity, and a single stack of plants:
            (1)   A-1 Agricultural District;
            (2)   I-1 Restricted Manufacturing and Warehousing District;
            (4)   I-2 Light Industrial District;
            (5)   I-3 General Industrial District.
         c.   A medical marijuana growing facility utilizing artificial light and flammable gas or flammable liquids, or industrial alcohol, or utilizing fertilizer or pesticides which exceed maximum allowable quantity, or where plants are double stacked:
            1.   I-3 General Industrial District.
      3.   Commercial medical marijuana processing facilities shall only be located within one (1) of the following zoning districts:
         a.   A medical marijuana processor which engages in trimming and packing, and/ or pre-rolls medical marijuana, and/or engages in baking, and/or utilizes water or ice:
            (1)   C-1 Neighborhood Shopping District;
            (2)   C-2 Office Commercial District;
            (3)   C-3 Planned Shopping Center District;
            (4)   C-4 General Commercial District;
            (5)   I-1 Restricted Manufacturing and Warehousing District;
            (6)   I-2 Light Industrial District;
            (7)   I-3 General Industrial District.
         b.   A medical marijuana processor which engages in low hazard extraction utilizing CO2 :
            (1)   I-1 Restricted Manufacturing and Warehousing District;
            (2)   I-2 Light Industrial District;
            (3)   I-3 General Industrial District.
         c.   A medical marijuana processor which engages in high hazard extraction utilizing flammable gas or flammable liquids, or industrial alcohol:
            (1)   I-3 General Industrial District.
      4.   Commercial medical marijuana transport facilities shall only be located within one (1) of the following zoning districts:
         a.   C-2, C-3, C-4 General Commercial District;
         b.   I-1 Restricted Manufacturing and Warehousing District;
         c.   I-2 Light Industrial District;
         d.   I-3 General Industrial District.
      5.   A Commercial Medical Marijuana Laboratory shall only be located within one of the following zoning districts:
         a.   A commercial medical marijuana laboratory which utilizes chemicals not exceeding the maximum allowable quantity:
            (1)   C-1 Neighborhood Shopping District;
            (2)   C-2 Office Commercial District;
            (3)   C-3 Planned Shopping Center District;
            (4)   C-4 General Commercial District;
            (5)   I-1 Restricted Manufacturing and Warehousing District;
            (6)   I-2 Light Industrial District;
            (7)   I-3 General Industrial District.
         b.   A commercial medical marijuana laboratory which utilizes chemicals exceeding the maximum allowable quantity:
