AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUNCAN, OKLAHOMA TO VACATE UNIMPROVED AND UNDEVELOPED ROAD RIGHT-OF-WAY COMMONLY REFERRED TO AS 13th STREET BETWEEN BOIS D’ARC AVENUE AND HIGHWY 7.
 
PURSUANT TO THE LEGAL NOTICE AS IS REQUIRED BY THE OKLAHOMA OPEN MEETING ACT INCLUDING THE POSTING OF NOTICE AND AGENDA AS IS REQUIRED BY THE TERMS THEREOF, THE DUNCAN CITY COUNCIL MET IN REGULAR SESSION AT CITY COUNCIL CHAMBERS IN DUNCAN, OKLAHOMA ON THE 23rd DAY OF MARCH, 2021 AT 5:15 O’CLOCK P.M.

ORDINANCE NO. 1818
 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUNCAN, OKLAHOMA TO VACATE UNIMPROVED AND UNDEVELOPED ROAD RIGHT-OF-WAY COMMONLY REFERRED TO AS 13th STREET BETWEEN BOIS D’ARC AVENUE AND HIGHWY 7.
 
WHEREAS, the City Council for the City of Duncan, Oklahoma considered an application filed by Jacob Johnson to vacate an unimproved and undeveloped road right-of-way commonly known as 13th Street between Bois D’Arc Avenue and Highway 7, Duncan, Oklahoma.
 
WHEREAS, the platted road right-of-way described as being:
 
A tract of land described as: Beginning at the NE/C of Lot 7 of Block 1 in Southerland Addition, City of Duncan, Stephens County, Oklahoma; Thence East a distance of 50.00 feet (+/-) to the NW/C of Lot 4 of Block 4 in Tucker Addition, City of Duncan, Stephens County, Oklahoma; Thence South, along the West Line of said Lot 4, a distance of 140 feet to the SW/C of said Lot 4; Thence Westerly a distance of 50.00 feet (+/-) to the SE/C of said Lot 7; Thence North, along the East Line of said Lot 7, a distance of 134.32 feet back to the Point of Beginning.  Said tract is a portion of Highway/Street Right-of-Way formerly known as Highway 81/13th Street. 
 
WHEREAS, the City of Duncan Plan Commission considered an application filed by Jacob Johnson to vacate the unimproved and undeveloped platted road right-of-way.  A record of the petition and Plan Commission action sending a favorable 4-0 recommendation is attached hereto and incorporated by reference as “Exhibit A.”
 
NOW, THEREFORE, BE IT ORDAINED, THAT THE CITY COUNCIL OF THE CITY OF DUNCAN SHALL PASS:
 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUNCAN, OKLAHOMA TO VACATE UNIMPROVED AND UNDEVELOPED ROAD RIGHT-OF-WAY COMMONLY REFERRED TO AS 13th STREET BETWEEN BOIS D’ARC AVENUE AND HIGHWY 7.
 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUNCAN, OKLAHOMA TO VACATE UNIMPROVED AND UNDEVELOPED ROAD RIGHT-OF-WAY COMMONLY REFERRED TO AS 13th STREET BETWEEN BOIS D’ARC AVENUE AND HIGHWY 7.
 
EMERGENCY CLAUSE
WHEREAS, it being immediately necessary for the preservation of the peace, health, safety and welfare of the City of Duncan, Oklahoma, and the inhabitants thereof that the provisions of this Ordinance be put into full force and effect, an emergency is hereby declared to exist by reason whereof this Ordinance shall take effect and be in full force from and after its passage as provided by law.
