4-601: ACTS PROHIBITED:
   A.   It shall be unlawful for any person to commit any of the following acts:
      1.   To maliciously overdrive, overload, torture, destroy or kill, or cruelly beat or injure, maim or mutilate, any animal in subjugation or captivity, whether dangerous or tame, and whether belonging to himself or to another.
      2.   Unjustly administer any poison or noxious drug or substance to any animal.
      3.   Unjustly expose any drug or substance with the intent that the same shall be taken by an animal, whether such animal be the property of that owner or another person.
      4.   To deprive any animal of necessary food, drink, shelter, proper light and ventilation, or medical attention reasonably required.
      5.   To cause, procure, or permit any of the occurrences enumerated in this subsection A or any other act tending to produce such cruelty.
      6.   To set afoot, instigate, engage in, or in any way further any act of cruelty to any animal, or do any act tending to produce such cruelty.
      7.   Cause any other person to do any of the above acts.
   B.   If an animal control officer finds an animal to be in one of the above described conditions, the officer may issue a citation to the offender and shall issue a notice to the offender warning him that if the animal's condition is not improved, another citation may be issued.
   C.   If within seventy two (72) hours, the condition of the animal is not improved to the satisfaction of the animal control officer, a citation shall be issued.
   D.   No dogs, cats or other small animals shall be confined within a motor vehicle under such conditions as may endanger the health or well being of the animal, including, but not limited to, dangerous temperature, lack of food or water.
   E.   No person shall abandon or cause to be abandoned any dogs, cats, or small animals.
   F.   No person shall give away any live animal, fish, reptile, fowl or bird as a prize for, or as an inducement to enter any contest, game or other competition, as an inducement to enter a place of amusement; or as an incentive to enter into any business agreement whereby the offer was for the purpose of attracting trade.
   G.   No animal or bird may be dyed or stained an artificial color for the purpose of offering for sale or giving away as a prize.
   H.   No person shall set or expose an open jaw type trap, leg hold trap, snare trap, or any type trap which would likely cause physical harm or injury to any animal. This provision shall not apply to persons who are licensed by the state to trap animals as provided in 29 Oklahoma Statutes section 4-119.
   I.   No person shall deposit any live dog, cat, or other domestic animal along any private or public roadway, or in any other private or public place with the intention of abandoning the domestic animal.
   J.   Upon conviction, any person found in violation of subsections A through H of this section shall be guilty of a misdemeanor. (Ord. 1510, 8-8-2000)
