6-1-5: UTILITY EASEMENTS:
   A.   Application, Bond Requirements: All utility easements sought within the county roads, rights of way and easements, including those easements that cross the highway, shall be granted only upon compliance with the following:
      1.   Proper application describing the nature and extent and location of the easement which is sought; (1998 Code § 12.04.070)
      2.   The posting of an appropriate bond or cash in the amount set by resolution. It shall be the responsibility of the applicant to repair any damage to the roadway which occurs during and for two (2) years subsequent to the installation of the utility in the appropriate easement. Said repairs shall be made according to the specifications of the road department. (1998 Code § 12.04.070; amd. 2010 Code)
   B.   Utility Companies: All utility easements sought by a utility company for the benefit of two (2) or more customers in the same area for easements within the county roads, rights of way and easements, including those easements across the highway, shall be granted only upon compliance of the following:
      1.   Proper application prescribing the nature and extent and location of the easement which is sought;
      2.   Posting of the appropriate bond in the amount to be set by the county commission. The amount of said bond shall be that amount which would be necessary to cover the costs of damages to the road as the result of the installation of the utility across the road or in the rights of way and easements of the county;
      3.   It shall be the responsibility of the utility company to repair any damage to the roadway which occurs during the installation of the utility. Said repairs shall be made to the specifications of the road department;
      4.   Upon the expiration of two (2) years from the date of completion of the utility project, the bond posted shall be released and returned to the utility company. If, during the course of the two (2) years, repair of the roadway becomes necessary due to the installation of the utility, then the county shall make claim against the bond for the amount of the repairs.
