3-4-16: MAINTAINING ILLEGAL SITE:
   A.   Notice To Remove:
      1.   The administrator, or his or her authorized agent, is authorized and empowered to notify the owner of any open or vacant private property within the county, or the agent of such owner, to properly dispose of solid waste located on such owner's property which is dangerous to public health, safety or welfare.
      2.   Such notice shall be by registered mail, addressed to said owner at his or her last known address.
   B.   Action Upon Noncompliance: Upon the failure, neglect or refusal of any owner or agent so notified to properly dispose of solid waste dangerous to the public health, safety or welfare within thirty (30) days after receipt of written notice provided for in subsection A of this section, or within thirty (30) days after date of such notice in the event the same is returned to the county because of its inability to make delivery thereof, provided the same was properly addressed to the last known address of such owner or agent, the administrator is authorized and empowered to order its disposal by the county.
   C.   Assessment For Costs Lien Payment: Cost of abating a nuisance within the meaning of this chapter (after opportunity for a hearing thereon) shall be a special assessment against the land on which such abatement was done, and shall constitute a lien, accrue penalties and interest, and be collectable in accordance with this chapter.
