A. Commercial, Industrial: Commercial and industrial wastes generated within the county shall be collected by a licensed or authorized collector, and must be disposed of at the Blue Bench landfill. An exception to this requirement may be granted for the business to dispose of its own waste in the Blue Bench landfill, under the following rules:
1. The business shall make application to the administrator;
2. The business shall certify by signed affidavit that all its generated waste will be disposed of at the Blue Bench landfill, which will provide verification of the same, and that it will not burn or discard such waste in an unlawful manner;
3. Transportation of the waste will be in compliance with state law and/or in such a manner so as to prevent the waste from blowing or spilling off the vehicle and/or causing roadside litter;
4. Submit to a periodic audit to ensure that its waste was properly disposed of. (1998 Code § 8.20.110)
B. Residential:
1. Residential waste shall be collected by a licensed or authorized collector, and must be disposed of in the Blue Bench landfill. (1998 Code § 8.20.120; amd. 2010 Code)
2. An exception to this requirement may be granted for private disposal at the Blue Bench landfill or other state permitted landfill under the following rules:
a. The resident shall make application to the administrator;
b. Certify by signed affidavit that all household garbage will be disposed of at the Blue Bench landfill or other state permitted landfill, and agree to provide verification of such, and that they will not burn, bury or discard such waste in an unlawful manner;
c. Transporting the waste will be done in such a manner as to prevent the waste from blowing or spilling off the vehicle and causing roadside litter;
d. Satisfy a periodic audit to ensure that their waste was properly disposed of.
3. Note: Where certain areas would accommodate dumpsters better than cans, residents may choose by negotiation with the licensed collector as to method preferred. (1998 Code § 8.20.120)
