3-4-3: DEFINITIONS:
For the purpose of this chapter, the following words and phrases shall have the meanings given herein unless their use in the text of this chapter clearly demonstrates a different meaning:
ABANDONED: Discarded, inoperable or no longer usable in its original or a similar capacity, and is unsightly or contributes to a risk to the health or safety of any person.
ADMINISTRATOR: The person appointed by the Duchesne County board of commissioners to administer solid waste management.
BLUE BENCH LANDFILL: The Duchesne - Wasatch jointly owned landfill located approximately eight (8) miles north of Duchesne, Utah, on section 32, township 2 south, range 4 west, Uintah special base and meridian.
BULKY WASTE: Means and includes large items of solid waste, such as appliances, furniture, large auto parts, trees, branches, stumps and other oversized waste, whose large size precludes or complicates their handling by normal collection, processing or disposal methods.
COLLECTION: The act of collecting solid waste at the place of generation by an approved collection agent (public or private).
COLLECTOR: Any person who operates service routes or provides service and is directly or indirectly reimbursed for the collection and disposal of solid waste from residential, commercial or industrial premises in the unincorporated area of Duchesne County.
COUNTY: The county of Duchesne, state of Utah.
COUNTY COMMISSION: The board of county commissioners of Duchesne County, Utah.
DISPOSAL SITE: Means and includes the place, location, tract, area or premises in use, intended to be used, or which has been used, for the disposal of waste.
GARBAGE: Means and includes all kitchen and table waste, and animal or vegetable waste that attends or results from the storage, preparation, cooking or handling of foodstuffs.
HAZARDOUS WASTE: Solid waste which is excessively toxic or poisonous, corrosive, irritating or sensitizing, radioactive, biologically infectious, explosive or flammable, and all waste classified as hazardous or infectious by state and federal law or regulation.
ILLEGAL DUMPING: The disposal of any solid waste in any place other than a private collection station or the Blue Bench landfill.
LANDFILL: A disposal site employing an engineered method of disposing of solid wastes that minimizes environmental hazards by spreading, compacting to the smallest practical volume, and applying cover material over all exposed wastes as required by statutes and regulations.
LICENSEE: A person who holds a valid, unrevoked and unexpired license to collect or transport solid waste issued pursuant to this chapter.
PERSON: Any individual, firm, association, copartnership, political subdivision, government agency, municipality, public or private corporation, or any other entity whatsoever.
PRIVATE COLLECTION STATION: Any authorized or licensed place for collection of solid waste. It shall also mean a can, dumpster or other receptacle specifically used for the temporary holding of solid waste.
PUTRESCIBLE WASTES: Means and includes wastes that are capable of being decomposed by microorganisms with sufficient rapidity as to cause nuisances because of odors, gases or other offensive conditions, and include materials such as food wastes, offal and dead animals.
REFUSE: Means and includes garbage and rubbish.
RESIDENCE OR RESIDENTIAL: Of, from or pertaining to any property or premises containing a structure which is used for human habitation. It shall include, but shall not be limited to, single homes, mobile homes, townhomes, condominiums and apartments not contained in or a part of an apartment complex of more than eight (8) units. It shall exclude hotels, motels, recreational vehicle developments and apartment complexes with more than eight (8) units, which shall be considered commercial establishments.
RESIDENTIAL WASTE: Means and includes garbage, rubbish and types of domestic wastes associated with or which originate in residential dwellings.
RUBBISH: Means and includes nonputrescible solid waste, such as ashes, paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery, plastics, rubber byproducts, small appliances or litter.
SALVAGING: The controlled or authorized storage or removal of waste for reuse.
SCAVENGING: The uncontrolled or unauthorized removal of solid waste materials.
SOLID WASTE: Means and includes all putrescible and nonputrescible solid and semisolid wastes, such as refuse, garbage, rubbish, paper, ashes, industrial wastes, demolition and construction wastes, abandoned vehicles and parts thereof, discarded home and industrial appliances, manure, vegetable or animal solid and semisolid wastes and shall include other discarded material classified as solid waste by state and federal law or regulation.
SOLID WASTE FACILITY: Includes a resource recovery facility, disposal site, a solid waste transfer or processing station, and a private collection station. (1998 Code § 8.20.080)
