§ 151.06 PLAT APPROVAL.
   (A)   All plats of a subdivision shall be submitted in proper number, size, and form. A Subdivision Review Committee (S.R.C.) is hereby established to assist with the technical evaluation of subdivisions, and to make recommendations to the Board of Commissioners. The S.R.C. shall consist of three members, being the County Surveyor, or the County Surveyor’s designee, the County Auditor, or the County Auditor’s designee, and one member selected, and appointed, by the Board of Commissioners. The S.R.C. is hereby given the authority to grant approval for minor subdivisions and parcelizations.
      (1)   All major subdivision plats will be submitted to the County Board of Commissioners for review as to compliance with this subchapter. Before taking any action to approve, or disapprove, a proposed plat, the County Board of Commissioners may require payment of a fee established by said Commissioners to cover the administrative costs related to said plat, and shall hold not less than one public hearing thereon, after publication of public notice of a hearing in accordance with I.C. 5-3-1, to be arranged, and paid for, by the applicant. If after the public hearing the County Board of Commissioners disapproves a proposed plat, the County Board of Commissioners shall make written findings that set forth its reasons and decision denying approval, and shall provide the applicant with a copy thereof.
      (2)   All minor subdivision plats will be submitted to the County Auditor’s office in the County Courthouse, where the S.R.C. will review for compliance with this subchapter. Before taking any action to approve, or disapprove, a proposed plat, the S.R.C. may require payment of a fee established by the County Board of Commissioners to cover the administrative costs related to said plat. Proposed plats will be given ten business days for review by the S.R.C. If, after the review, the S.R.C. disapproves the proposed plat, the S.R.C. shall make written findings that set forth its reasons and decision denying approval, and shall provide the applicant with a copy thereof.
   (B)   Any person feeling himself or herself aggrieved at any action of the County Board of Commissioners, or the S.R.C., or the Board’s staff, or the lack of action of the County Board of Commissioners, or the S.R.C., or the Board’s staff, upon a proposed plat or replat, may apply, in writing, to the County Board of Commissioners, prior to the next regular meeting, for modification of the action complained of, or lack of action, on the proposed plat or replat. Such application shall be considered by the County Board of Commissioners at such time, in such manner as it may determine, but within 60 days following the regular meeting.
