§ 50.03 CONNECTION TO SANITARY SEWER SYSTEM.
   (A)   The owner of any real estate within the county upon which is located any structure or improvement producing sanitary sewage or waste, and which improvement, or any portion thereof, is located within 300 feet of any collection line maintained as part of a public sanitary sewer system, shall disconnect from, and discontinue use of, any septic tank or similar disposal system, and shall connect said improvement(s) to said sanitary sewer system, and shall comply with such service and other regulations as may be, from time to time, established by the operator of said public sewer system.
   (B)   Notwithstanding the provisions of division (A) above, any structure or improvement producing sanitary sewage or waste which is served by a septic tank, or similar system, which system has been installed pursuant to a permit issued by the County Health Department prior to installation of a public sanitary system described in division (A) above, shall be entitled to continue use of said septic tank, or similar system, until the earlier of either of the following events:
      (1)   The passage of seven years from the date of installation of said septic tank, or similar disposal system; or
      (2)   The determination by the County Health Department that said septic tank, or similar disposal system, has ceased to properly function.
   (C)   Connection to a public sewer system, and disconnection from a septic tank, or a similar disposal system, when required under division (A) above, shall be completed within 45 days following written notice mailed to a real estate owner from the operator of such public sanitary sewer system, or from the County Health Department, or from any governmental agency that said public sanitary sewer system is available for use by said owner’s real estate improvements.
   (D)   In the event that an owner has delayed connection under division (B) above, said owner shall connect to the public sewer system and disconnect from the exempted septic tank, or a similar system, on, or prior to, the end of the exemption period.
   (E)   In the event of a non-functioning septic tank, or similar a system, within the period specified in a written notice from the County Health Department, which specified date shall be not less than 15 days, nor more than 45 days, from the date of said notice.
